İnsana hürmetin fıkha etkisi

İnsan kerem sıfatına sahip bir şekilde yaratılmış olup diğer canlılardan üstün tutulmuştur. Keramet; din, ırk, mezhep vb. ayrım yapılmaksızın insanın sadece insan olmasından kaynaklanan, ortadan kalkması düşünülemeyen ve tüm insanlarda bulunan bir sıfattır. İnsanın kerem sıfatına sahip olması fıkhi hükümlere de yansımıştır. Bu çalışmada insana gösterilen hürmetin fıkıhtaki yansımaları tespit edilmeye çalışılmıştır. Bu çalışma bir giriş ve üç bölümden oluşmaktadır. Giriş bölümünde çalışmanın konusu, kapsamı, amacı, önemi ve izlenen yöntem anlatılmıştır. Birinci bölümde konu etrafında zikredilen kavramsal çerçeve ve fıkıh usûlü alanında yer alan deliller çerçevesinde konu değerlendirilmiş ve fıkıh usulünün diğer konuları arasında yer alan örnekler anlatılmıştır. İkinci bölümde ibâdât, muâmelat, İslâm ceza hukuku, İslâm miras hukuku ve İslâm aile hukukunda yer alan konu ile ilgili örnekler zikredilmiştir. Üçüncü bölümde ise insana hürmeti ilgilendiren güncel meseleler ele alınmıştır. Sonuç kısmında ise elde edilen verilerin tahlili yapılmıştır.

Human beings have been created with the attribute of generosity and are considered superior to other living creatures. Generosity is an attribute that arises from the mere fact of being human, without distinctions based on religion, race, sect, and so on. It is an inherent quality that is present in all human beings and cannot be eliminated. The possession of the attribute of generosity by humans has also found its reflection in the legal principles of Islamic jurisprudence (Fiqh). This study aims to identify the legal implications of the respect accorded to humans. This study comprises an introduction and three main sections. The introduction provides an overview of the subject, its scope, objectives, significance, and the methodology employed. The first section discusses the conceptual framework surrounding the topic and evaluates it within the framework of evidence found in the field of Islamic jurisprudential principles (fiqh usul). In the second section, the topic and examples are mentioned in the context of acts of worship (ibadat), transactions (muamalat), Islamic criminal law, Islamic inheritance law, and Islamic family law. In the third section, contemporary issues related to the respect for humans are addressed. The conclusion section provides an analysis of the data obtained.
