İslam Hukukunda akitlerde satış bedeli (Semeniyet)

Alışverişlerde verilen bedellerden birinin ismi olan semen kavramının inceleneceği bu çalışma bir giriş, üç bölüm ve bir sonuç kısmından oluşmaktadır. İlk bölümde semenin akit içindeki yeri, şartları ve ilişkili olduğu kavramlar ele alınmıştır. İkinci bölümde akit çeşitlerinde semenin konumu ve şartlarındaki değişiklikler açıklanmaya çalışılmıştır. Bu minvalde klasik kaynaklarda bey' çeşidi olarak ifade edilen temel akit çeşitleri açıklandıktan sonra semen eksenli bir incelemeye tabi tutulmuştur. Son bölümde ise semenin verilme aşamasında tabi olduğu şartlar, paranın değerinde oluşan değişiklikler, teslimden önce semende tasarruf ve semende oluşacak zararlar gibi semene ait hükümler araştırmaya konu edilmiştir. Sonuç kısmında ise çalışmada tespit edilen özelliklerden önemli kısımlar topluca ele alınarak çalışma sonlandırılmıştır.

This study, in which the concept of "semen", which is the name of one of the purchases given, consists of an introduction, three chapters and a conclusion. In the first chapter, the place of "semen" in the contracting, its terms and the concepts in which it is related are discussed. In the second chapter, it is tried to explain the changes in the position and terms of "semen" in the contract types. From this point of view, the main contract types, which are expressed as the type of shopping in the classical sources, the remuneration was subjected to an axial analysis. In the last chapter, remuneration provisions such as the payment stage conditions that the remuneration was subject to, the changes in the value of money, the savings in remuneration before delivery and the damages in remuneration were investigated. In the conclusion part, the important parts of the features determined in the study viewed in whole and the study was terminated.
