Hanefi mezhebine göre evlenme ehliyeti ve çocukların evlendirilmesi meselesi (Modern hukuk mukayeseli)

Bu araştırmanın amacı, İslam hukukunda çocukların evlendirilmesinin hukuki dayanağını ortaya koymaktır. Ayrıca bu problemin günümüz hukuk sistemindeki yerini tespit etmektir. Çocukların evlendirilmesi konusu tartışılmış sonuçta çocukların evlendirilmesini kabul edenler ve etmeyenler şeklinde iki temel görüş ortaya çıkmıştır. Bu araştırma, giriş, iki bölüm ve sonuçtan meydana gelmektedir. Giriş kısmında evlenmenin mahiyeti hakkında bilgi verilmiştir. Birinci bölümde Hanefi mezhebine göre evlenme ehliyeti ele alınmıştır. Evlenme için gerekli olan ehliyet ve velâyet konuları incelenmiştir. İkinci bölümde çocukların evlendirilmesi İslam hukuku açısından incelenerek farklı görüşler ortaya konulmuştur. Bu konudaki Osmanlı kanunlarına ve günümüz hukuk sistemindeki kanunlara değinilmiştir. Sonuç bölümünde ise konu ile ilgili tespit edilen görüşlerin değerlendirilmesi özet olarak verilmiştir.

The main purpose of this research is to reveal the legal basis of the marriage of children in Islamic law, at the same time to determine the place of this problem in today's legal system. The topic of marrying children was discussed and two main views emerged, the once who are accepting and the once who are not accepting the marriage of children. This research consists of an introduction, two chapters and one conclusion part. In the introduction you can find the given information about the nature of marriage. In the first part is discussed the license to marriage according to Hanafi sect. The legal competence and custody issues required for marriage were examined. In the second part, we can find the marriage of children which is examined in terms of Islamic law and different opinions are also presented. In this issue we can address to the Ottoman’s law and today's legal system. In the conclusion part, we can find the evaluation of the opinions on the subject which are summarized.
