Özet

The principle of trust in the land registry has a very strong place in Turkish law. This principle is valid for all immovables without reservation and without exception. Because the registers in the land registry are related to immovables. The name of the principle is the principle of trust in the land registry. If a simple definition is made, it can be defined as protection of bona fide third parties against wrongful registration and wrongful abandonment. The basis of the principle of trust in the land registry is the choice made as a result of a responsibility undertaken by the state. In this respect, the principle of trust in the land registry is a result of the choice made to prioritize the rights and interests of one party over the other. The state protects the gains of those who qualify by relying on any record in the registry. Even if the record in the registry does not reflect the real situation, if the person who made the acquisition has good faith, he has earned the right.
