Mâturîdî'nin Te'vîlâtü'l-Kur'an'ında fıkhî görüşleri (Bakara suresi- ibadetler ve helaller-haramlar

M âverâü n n eh ir bölgesinin S em erkant şehrinde dünyaya gelen E bû M an su r M âtu rîd î (333/944), kelâm ve fıkıh alanında H anefî m ezhebinin önde gelen reislerindendir. M âturîdi, kelâm î m eseleler başta olm ak kaydıyla ahlâki, sosyal ve fıkhî problem lere ilişkin getirdiği çözüm önerilerinde n asların yanında akla da gereken değeri ve önem i verm iş, fark lı düşünceye sahip olana k arşı m üsam ahayı ve ötekinin görüşlerine saygı gösterm eyi sağlam ış, gerek yaşadığı dönem de ve gerekse günüm üzde görüşlerinden etkilenen ilim çevreleri ile bu ekole m ensup toplum ların baskın özellikleri olm uştur. E serlerinden günüm üze k a d a r ikisine ulaşabilm iştir. B unlardan T e’vîlâtü’l-K ur’an ilk dirâyet tefsirlerinden birisi olm asının yanında, özellikle ahkâm âyetlerinin tefsirinde fıkhın usul ve m eselelerine d air kon u lara genişçe yer verm iştir. Bu çalışm am ızda B ak ara suresi özelinde M â tu rîd î’nin fıkhî görüşlerini incelem eye çalıştık. Üç bölüm den oluşan çalışm am ızda, M âtu rîd î’nin hayatı ve eserleri, H anefî geleneği içerisindeki konum u, içtihat ehliyetine sahip olup olm adığı, eğer sahipse hangi ta b ak a m üçtehidi olduğu, fıkhi görüşlerinde H anefîlerle aynı k an aatti paylaştığı yönler ile ayrı düşündüğü h ususlar belirlenm eye gayret gösterilm iştir.

A bu M an su r al-M âtu rîd î (333/944), who was born in S am arkand in M aw arau n n ah r region, is one of the prom inent heads of the H anafi school in the field of theology and ju risprudence. A p a rt from the scriptures M âtu rîd i gave necessary im portance to the reason in o rd er to provide the solution for the problem s prim arily restricted to theological issues as well as m oral, social and ju rid ical them es. H e ensured tolerance of w hom has different thoughts and respect for the views of the other. Thus, his ideas, w hether in his life tim e or today, have becom e dom inant characteristics of the scholarly environm ents w hom have been influenced by his view w ith the societies belong to this school. Two of his w orks am ong the others have reached to this day. O ne of those T a ’wilât al-Q ur’ân w hich besides being the first com m entary of the Q u r’an by sound opinion (tafsir b i’d-dirayah) it gives a w ide range of ju rid ical issues on principle and details about the interp retatio n of the ju rid ical verses in p articu lar. In this study, we tried to exam ine ju rid ical opinions of M âtu rîd î in the case of S u rat al-B aqara. In our study w hich consists of three sections, we tried to determ ine the life of M âtu rîd î and his W orks, the position he had in the H anafi trad itio n considering w hether he had the capacity of ijtihad or not, if he had in w h at degree he gained as a legal expounder of Islam ic law (m ujtahid) and w ith reg ard to his ju rid ical opinions in w hat opinion he agreed w ith H anafis and in w hat he differed.
