Fıkıh Usulünün Klasik İslam Siyaset Düşüncesindeki Etkisi: Cüveyni Örneği

Bu çalışma şer’i siyasette fikih üsülü yöntemini ele almıştır. Bu yöntem İmamü’l Harameyn Abdulmelik bin Abdullah el-Cüveynî’nin (ö. 487/1085) temayüz ettiği ve diğerlerinden ayrıldığı bir yöntemdir Mukaddimede araştırmacı çalışmanın konusunu, sorunu, sorularını, sınırlarını, gerekliliklerini, önemini, konunun seçilme nedenlerini, hedeflerini, yöntemini, kaynaklarını, önceki çalışmaları ve araştırma planını ele almıştır. İlk bölümde ise araştırmacı çalışmanın kavramlarını, İmam Cüveynî’nin hayatını, Selçuklu veziri Nizamülmülk’e ulaşan siyasi ve usuli telifleri, şer’i siyaset ile genel olarak İslam siyasi mirasında fikir usullerinin karşılaştırılmasına dair yöntemi ve İmam Mâverdî’nin üslubunu işlemiştir. İkinci bölümde çalışmada Kuran, sünnet, ve ikisi ile ilgili istinbat kaideleri ele almıştır, ayrıca icma delilini ve bu üç delilin İmamü’l Harameyn’e göre şer’i siyasetteki etkisi ele alınmıştır. Üçüncü bölümde ise çalışmada kıyas delili, ve diğer ferii deliller İmamü’l Harameyn’e göre şer’i siyasete olan etkisi ele alınmış ve bu bölüm İmamü’l Haremeyn’in şeriat fakültelerinin ve amaçlarının açıklanması hususundaki görüşleri ve şer’i siyasete olan tesirinin incelenmesiyle sonlandırılmıştır. Hatime kısmında araştırmacı bu çalışmanın en önemli sonuçlarını aktarmıştır.

The study tackled the approach of juristic consideration\examination in studying the Islamic lawful policy. It is the same approach that Imam al-Hrmyn Abdel-Malik bin Abdullah Al Juwayni (a.h. 478/1085 c.e.) has excelled and was distinguished for where the effect of his book Al-Burhan in Islamic Jurisprudence fundamentals was clearly shown in his book Ghias Nations in embololalia injustice. The study was distributed over an introduction, three chapters and a conclusion. Within the introduction, the researcher presented the topic of the study, the problem statement, its questions, its boundaries, its hypothesis, its importance and the reasoning behind selecting its topic, goals, methodology, resources, the previous studies and the research plan. In the first chapter, the researcher tackled the study concepts and the character of Imam Aljuwaini, his juristic and political selections, his relation with the Seljuk minister Nizam al-Mulk, his methodology in studying the Islamic lawful policy in comparison with the approach of consideration\examination in the Islamic policy heritage generally and the approach and way of Imam Al-Mawardi in particular. In the second chapter, the study tackled the evidences from the Holy Quran and the prophetic tradition (Sunnah), and what they included of rules of inference, and the evidence of consensus (Ijma’), and the effect of these three evidences on the Islamic lawful policy for Imam Aljuwaini. In the third chapter, the study tackled Imam Aljuwaini’s evidence of measurement (Qiyas) and the other dependent evidences that are contentious in the science of Islamic Jurisprudence, and its effect on the Islamic lawful policy. The chapter was ended by identifying the purposes\goals of Islamic law and legislation for Imam Aljuwaini and its effect on setting the Islamic lawful policy. In the conclusion, the researcher highlighted the results and findings of the study.
