Zekeriyya El Ensari'nin Esne'l- Metalib Adlı Eserinde Aile Hukuku ile İlgili Kaideler

Abstract

Fıkhi kaideler, fıkıh ilminin ürettiği önemli ürünlerden bir tanesidir. Fıkhın genel mantığını yansıtan, bir veya birçok konudaki hükümlerin teşekkülündeki gerekçeleri veciz bir şekilde ifade eden bu kaideler, fıkıhla ilgilenen her seviyedeki ilim insanına ilim tahsili ile ifta/ictihad faaliyetlerinde kolaylık sağlamaktadır. Fıkhi kaidelerle ilgili çok sayıda çalışmadan oluşan geniş bir literatür bulunmaktadır. Bu literatürü oluşturan bazı araştırmalar, fıkıh kaynakları içerisinde dağınık halde bulunan külli kaidelerin tespitine yöneliktir. Bu metotla yapılan bu tezde Zekeriyyâ el-Ensârî'nin Esne'l-Metâlib adlı eserinin ahvâl-i şahsiyye bölümlerinde geçen fıkhi kaidelerin tespiti ve değerlendirmesi yapılmıştır. Çalışma, bir giriş, üç bölüm ve bir sonuçtan oluşmaktadır. Giriş bölümünde konunun önemi, amaçları, sınırları ve konuyla ilgili önceki çalışmalar zikredilmiştir. Birinci bölümde, müellifin biyografisi ve eserleri anlatılmış, çalışmanın ana kaynağı olan Esne'l-Metalib adlı eseri tanıtılmıştır. İkinci bölümde fıkhi kaide kavramı ele alınmış; fıkhi kaideler ile fıkhi zâbıtlar arasındaki farklar, fıkhi kaidelerin rükünleri, şartları, delil değeri ve kaynakları incelenmiştir. Çalışmanın ana konusunu teşkil eden son bölümde ahvâl-i şahsiyye bölümlerinde geçen fıkhi kaidelere yer verilmiş, tespit edilen 19 kaide zikredilmiştir. Fiqh rules are one of the important products generated by fiqh science. These rules, which reflect the formal logic of fiqh and briefly express the reasons for the formation of provisions on one or more issues, enable the scholars at every level who are interested in fiqh in their studies and ifta/ijtihad activities. There is a vast literature consisting of various studies on fiqh rules. Some of the studies constituting this literature aimed to determine the universal rules found disorganizedly in the sources of fiqh. In the thesis conducted with this method, the fiqh rules in the al-ahwal al-shahsiyyah (personal status) sections of Zekeriyya al-Ansârî's work titled Asna'l-Matalib were determined and evaluated. The study consists of an introduction, three parts, and a conclusion. In the introduction, the importance of the topic, its aims, limits, and previous studies on it are mentioned. In the first part, the biography and works of the author are explained, and his work titled Asna'l-Matalib, which is the primary source of the study is introduced. In the second part, the concept of fiqh rule is discussed and, the differences between fiqhi rules and zabids, the elements, conditions, evidentiary value, and sources of fiqhi rules are examined. In the last part, which is the main topic of the study, the fiqh rules in the parts of al-ahwal al-shahsiyyah are included, and nine-teen rules determined are indicated.
