Serahsî’nin Alişveriş Bahislerindeki Tercihleri

“Serahsî’nin Alişveriş Bahislerindeki Tercihleri” isimli bu tez, bir giriş, iki bölüm, bir sonuç ve ek-1 olarak bir istatistikten oluşmaktadır. Giriş bölümünde konunun önemi, sınırları araştırmanın yöntemi ve kaynakları ile birlikte kısaca Serahsî’nin hayati ele alınmıştır. Birinci bölümde Serahsî’nin el-Mebsût isimli eseri dikkate alınarak alışveriş bahislerindeki tercihleri ve tercihlerin gerekçeleri tespit edilmeye çalışılmış ve neticede derli toplu bir bilgi sunulmaya gayret edilmiştir. Bununla birlikte ihtiyaç görünen yerlerde de kısa değerlendirmeler yapılmıştır. İkinci bölümde ise ele alınan bahislerinde delil olarak kullanılan küllî kaideler tespit edilerek, hangi meselelerde kullanıldığına dair örnekler sunulmuştur. Sonuç başlığı altında Serahsî’nin eserinin yazma metodu üzerinde durulmuştur. Son olarak EK-1’de “Serahsı̇’nı̇n Tercih Ettı̇ğı̇ Görüşlerı̇nı̇n İstatı̇stı̇ğı̇” başlığı altında Serahsî’nin tercihleri ayrı ayrı başlıklar altında toplanarak bir şablon halinde sunulmaya gayret edilmiştir.

“Serahsi’s Preferences In Sales Contracts” consists of an introduction, two chapters, an evaluation and statistics. In the introduction part, the importance and limits of the subject and the method and sources of the research are stated. Also in this part; the life of Serahsi is briefly discussed. In the first part, taking into account his work named Mebsût- it was tried to determine the views and preferences of Serahsî in the subject of the fiqh of sale’s contract and was presented in a compact from. However, short evaluations were made where needed. In the second part, the maxims of Islamic law used as principle in the sale’s contrcts were determined and examples were presented on which issues they were used. In evaluation section, the writing method of Serahsi’s work are emphasized and mentioned the idealogies of the imams which Serahsî has adopted as well as the ones he didn’t. Lastly, in the statistics, Serahsi’s preferences were gathered under separate headings and an effort was made to present them as a template.
