Özet
Türkiye, coğrafi konumu ve iklimsel yapısı gereği çeşitli doğal afet risklerine açıktır. Bu tez çalışmasının odak noktası, sel afeti sonucu ortaya çıkan zararlar karşısında idarenin hukuki sorumluluğunun kapsam ve sınırlarını incelemektir. Tez iki bölümden oluşmaktadır. Birinci bölümde doğal afet kavramı açıklanmakta; özellikle sel bağlamında afet öncesi alınması gereken önlemler, afet sırasındaki müdahaleler ve sonrasında yürütülecek faaliyetler çerçevesinde idarenin görevleri ele alınmaktadır. Çalışmanın ikinci bölümünde, sel afeti nedeniyle meydana gelen zararlardan dolayı idarenin hukuki sorumluluğu incelenmektedir. İdarenin sorumluluğu Danıştay kararları çerçevesinde değerlendirilmekte ve yargı içtihatları doğrultusunda belirli kategorilere ayrılmaktadır. Bu kapsamda; sel afeti meydana gelmeden önce idarenin alması gereken önlemlere ilişkin sorumluluğu, sel afeti sırasında idarenin sorumluluğu, sel afeti meydana geldikten sonra idarenin sorumluluğu ve birden fazla kamu idaresinin birlikte sorumluk durumu incelenmektedir.
Türkiye is exposed to various natural disaster risks due to its geographical location and climatic structure. The focus of this thesis is to examine the scope and limits of the administration's legal responsibility in the face of damages resulting from floods. The thesis consists of two sections. The first section explains the concept of natural disasters, particularly focusing on floods, and discusses the duties of the administration in terms of measures to be taken before a disaster, interventions during a disaster, and activities to be carried out afterward. The second part of the study addresses the legal liability of the administration for damages caused by flood disasters. The administration's liability is assessed within the framework of Council of State decisions and addressed under specific categories in accordance with judicial precedents. In this context, the administration's responsibility regarding the measures it must take before a flood disaster occurs, the administration's responsibility during a flood disaster, the administration's responsibility after a flood disaster occurs, and the situation of joint responsibility of multiple public administrations are examined.
