dc.description.abstractCeza muhakemesinde maddi gerçeğin ortaya çıkarılması amacıyla bir takım faaliyetler yürütülmektedir. Bu faaliyetlerin çoğunluğu ise delillerle alakalıdır. Şüphenin yenilmesi için deliller toplanır, muhafaza altına alınır, duruşmada ortaya konularak tartışılır ve hakim tarafından takdir edilir. Bu çalışmada delillerle ilgili yürütülen bu faaliyetlerden delillerin tartışılması incelenmiştir. Delillerin tartışılması, delil olarak ileri sürülen olguların kabul edilip edilmemesine ilişkin yürütülen bir faaliyettir. Bu faaliyet, delille ilgisi olan herkesin katılımı ile delillerin sorgulanmasını sağlamaktadır. Türk Hukukunda delillerin tartışılması; delillerin elde edilmesi, ortaya konulması ve değerlendirilmesi kavramları ile birlikte ele alınmaktadır. Bu çalışmada delillerin tartışılması faaliyetinin diğer faaliyetlerden farkı ortaya konulmaktadır. Bu yapılırken ceza muhakemesinin demokratik ve diyalektik niteliği ön plana çıkartılmaktadır. Böylelikle maddi gerçeğin ortaya çıkarılmasında insan haklarına uygun bir ceza muhakemesinin bazı ince detaylarına da değinilmiş bulunulmaktadır. Çalışmamızın birinci bölümünde delil ve ispata ilişkin genel bilgiler verilmiştir. İkinci bölümde delillerin tartışılmasına ilişkin ilkeleri üzerinde durulmuş ve tartışmanın süjeleri belirlenmiştir. Son bölümde ise delillerin tartışılması usulü incelenmiştiren_US
dc.description.abstractIn order to reveal the material truth in criminal procedure, a number of activities are carried out. The majority of these activities are related to evidence. In order to destroyed of doubth, evidence is collected, taken under protection, discussed at the hearing and evaluated by the judge. In this study, the discussion of evidence from these activities is examined. The discussion of the evidences is an activity carried out on whether to accept the facts that may acceptable as evidence. Discussion of evidence in Turkish Law is examined with together concepts of putting forth and evaluating of evidences. In this study, the difference of the discussion of the evidence from other activities is presented. In doing so, the democratic and dialectical character of the criminal procedure is highlighted. In this way, some fine details of a criminal procedure which is appropriate for human rights have been mentioned in revealing the material truth. In the first part of our study, general information about evidence and proof is given. In the second chapter, the principles of discussion of the evidences were discussed and the subjects of the discussion were determined. In the last section, the method of discussion of the evidence is examined.en_US
