dc.description.abstractBu tezde kamu malı hırsızlığına dair merfû nitelikli rivayetler incelenmiştir. Giriş kısmında araştırmanın konusu, amacı ve öneminin yanı sıra kamu malı ve gulûl kavramlarının mahiyeti ile fukahânın kamu malı hırsızlığına dair görüşleri arz edilmiştir. Birinci bölümde kamu malı hırsızlığından bahseden sahih ve hasen rivayetler sened ve metin yönünden ele alınıp değerlendirilmiştir. Bu noktada rivayetin sıhhatini tespit etmede rical kitaplarından, muhtevasını analiz etmede ise şerh çalışmalarından istifade edilmiş ve böylece hem hadisin sağlamlığı hem de hangi manaları ihtiva ettiği meydana çıkarılmıştır. İkinci bölümde ise kamu malı hırsızlığına dair varid olan zayıf ve mevzû rivayetler isnad ve metin bakımından etüt edilmiştir. Burada da rical kitaplarından faydalanılarak senedin sıhhati ortaya koyulmuş, buna ilaveten gerekli noktalarda metin tenkidine de başvurulmuştur. İncelemeler neticesinde kamu malı hırsızlığından söz eden sahih ve hasen rivayet sayısının 22, zayıf ve mevzû rivayet sayısının ise 24 olduğu ortaya çıkmıştır.en_US
dc.description.abstractIn this thesis, narrations ascribed to the Prophet regarding property theft has been examined. In the introduction, the subject, purpose and importance of the research, as well as the nature of the concepts of public goog and ghulūl, and the opinions of al-fukaha on public good theft are presented. In the first part, the acceptable hadiths that talk about theft of public good are handled and evaluated in terms of text and legal document. At this point, in determining the validity of the narration, rijal books were used, and commentary studies were used to analyze its content, and thus both the soundness of the hadith and its meanings were revealed. In the second part, the discarded narrations about the theft of public good are studied in terms of the chain of transmission and text. Here, the authenticity of the text has been demonstrated by making use of the narrators books, in addition to this, criticism of the legal document was also applied when necessary. As a result of the investigations made, it was revealed that the number of acceptable narrations about public good theft was 22 and the number of discarded narrations was 24.en_US
