dc.description.abstract“İslam Ceza Hukukunda Suçlu Psikolojisi” başlıklı bu tezde suçlunun psikolojisi ve suç lunun psikolojisine etki eden unsurlar ele alınmıştır. Tez, giriş, dört bölüm ve sonuçtan oluşmak tadır. Giriş bölümünde konunun önemi, amacı, yöntemi, kaynakları ve sınırları belirtilmiştir. Birinci bölümde suçlunun suç aşamasındaki psikolojisi bağlamında suçun tanımı, suç sis tematiği, psikolojik yönden suçun unsurları ve suçun psikolojik nedenleri ile İslam düşüncesinde suçun nedenleri ele alınarak suç ve nedenleri hakkında genel bir değerlendirme yapılmıştır. İkinci bölümde cezalandırma aşamasında suçlu psikolojisi bağlamında cezaî sorumluluk ve cezaî ehliyet kavramları açıklanmış, akıl hastalıklarının tasnifleri incelenmiştir. Akıl hastalık larından şizofreni, duygudurum bozuklukları, epilepsi, dürtü kontrol bozuklukları ve zakâ geri liğinin cezaî sorumluluğa ve cezaî ehliyeti etkisi ele alınmıştır. Akıl hastalığı kapsamında olup olmadığı tartışılan uyurgezerlik, hipnoz, demans, canavarca his, haksız tahrik, tasarlamanın ce zaî sorumluluğa ve cezaî ehliyeti etkisi ele alınmıştır. Akıl hastalarının hukuki sorumluluğu ile akıl hastalarının ıslahı ele alınmıştır. Üçüncü bölümde infaz aşamasındaki suçlunun psikolojisini incelemek üzere cezanın amaçlarından caydırıcılık, ıslah ve kefaretin; cezanın özelliklerinden kanunilik, şahsilik, genellik ve denkliğin; cezalardan ölüm, celde, kısas, el kesme, sürgünün izahı yapılmıştır. Psikolojik açı dan infazın ilkeleri on maddede ele alınmıştır. Dördüncü bölümde ise infaz sonrası suçlu psikolojisi bağlamında cezasını çekmesinin akabinde infazı sona eren suçlunun tekrar suç işlememesi, topluma yeniden kazandırılması için takip edilmesi gereken psikolojik eğitim metotları ve suçluya iade edilmesi gereken psikolojik haklar ele alınmıştır. Sonuçta ise İslam ceza hukukunda suçlunun psikolojisinin bütün aşamalarda dikkate alındığına işaret edilmiştir.en_US
dc.description.abstractIn this thesis titled “Criminal Psychology in Islamic Criminal Law”, the psychology of the criminal and the factors affecting the psychology of the criminal are discussed. The thesis consists of an introduction, four chapters and a conclusion. In the introduction, the importance, purpose, method, sources and limits of the subject are stated. In the first chapter, the definition of crime in the context of the criminal's psychology in the crime stage, the crime systematic, the psychological elements of the crime and the psycholog ical reasons of the crime, and the reasons for the crime in Islamic thought are discussed and a general evaluation is made about the crime and its causes. In the second part, the concepts of criminal responsibility and criminal liability in the context of criminal psychology in the punishment phase are explained and the classifications of mental illnesses are examined. The effects of mental illnesses such as schizophrenia, mood disor ders, epilepsy, impulse control disorders and mental retardation on criminal responsibility and criminal liability are discussed. Sleepwalking, hypnosis, dementia, monstrous feeling, unjust provocation, and the effects of planning on criminal responsibility and criminal liability, which are discussed as being within the scope of mental illness, are discussed. The legal responsibility of the mentally ill and the rehabilitation of the mentally ill are discussed. In the third chapter, in order to examine the psychology of the criminal at the stage of execution, deterrence, correction and expiation; the legality, personality, generality and equiva lence of punishment; Among the punishments, death, execution, retaliation, cutting of hands and exile are explained. In the fourth chapter, in the context of post-execution criminal psychology, the psycho logical training methods that must be followed in order to reintegrate the criminal into society, and the psychological rights that must be returned to the criminal are discussed. As a result, it has been pointed out that the psychology of the criminal is taken into ac count at all stages in Islamic criminal lawen_US
