dc.description.abstractÇocuk istismarı, çocuğun bakım, gözetim ve terbiyesinden sorumlu olan şahıslar ya da toplumun diğer birey ve kuruluşları tarafından çocuğun büyüme ve gelişmesini olumsuz yönde etkileyen her türlü tavır ve davranış olarak nitelendirilebilen bir olgudur. Çocuk istismarı tarih boyunca her toplum ve kültürde rastlandığı gibi, son bir asırdır dünya gündemini daha çok meşgul eden bir olgu haline gelmiştir. Biz bu çalışmamızda çocuk istismarını İslam aile hukuku açısında ele almaya çalıştık. Çalışmamız boyunca gerek Kur'an-ı Kerim ve Sünnet'teki ifadeler açısından gerekse İslam hukukunun çocuklarla ilgili genel hükümleri açısında olsun, çocuk istismar ve ihmaline karşı birçok önleyici tedbir getirdiğine şahit olduk. Özellikle de normal ana-babalı çocuklara göre daha zayıf ve istismar edilmeye daha çok elverişli pozisyonda olan, yetim ve terk edilmiş buluntu çocuklarla ilgili hükümlere bakıldığında, İslam hukuku bu çocukları her türlü tehlike ve istismara karşı daha çok koruma altına almış ve bunların korunup himaye edilmesi için daha fazla gayret sarf etmiştir.en_US
dc.description.abstractChild abuseis aphenomen on which is all kinds of attitudes and behavior that have adversely affect to the child's growth and development which relate with caring, supervising and disciplining of child in the responsibility of persons or other individuals of a society and organizations. Child abuse has existed in every culture as well as through history but especially in the recent century which has occupied the world's agenda alot. In this study we tried to address child abuse in terms of Islamic family law. Through out the study in terms of both the expressions of Quran and Sunnah as well as in terms of the general provisions of Islamic law we have seen many preventive measures against child abuse and neglect. In particular, the orphaned and abandoned children are we aker than normal main-paternity children and are in very convenient position to be abused. We have investigated the provisions of İslamic law that have introduced a lot of preventive mesures against child abuse and their protection.en_US
