| dc.description.abstract | Hanefiler, fıkıh mezhepleri içerisinde istihsan yöntemini en belirgin şekilde kullanmışlardır. Kural olarak istihsanı kıyasa önceleyen Hanefiler, bazen kıyası istihsana takdim etmişlerdir. Kıyasın istihsana öncelendiği yerlerdeki istihsanın aslında hafi kıyas istihsanı olduğu bir gerçektir. Hafi kıyas istihsanının, kıyas olduğu düşünüldüğünde takdim edilen kıyasın illeti burada işlevseldir. Zira illetin kuvvet ve zayıflığı kıyasın veya istihsanın tercih edilme tarafını belirleyicidir. Bu araştırmada kıyasın istihsana öncelendiği 11 örneğin tahlili yapılmış olup, bu örneklerde kıyas veçhi, istihsan veçhi ve kıyasın tercih edilme sebepleri açıklanmıştır. Zaruri olarak istihsanın delil oluşunu, bunu kabul eden ve etmeyen ekollerin tez ve antitezlerini de araştırmacılar bu çalışmada bulabilirler. | en_US |
| dc.description.abstract | Hanafism used the method of istihsan the most remarkably in fiqh schools. Hanafism, which prioritize istihsan to qiyas as a rule, sometimes prioritize qiyas to istihsan. It is a reality that istihsan, in the places, where qiyas is prioritized to istihsan, is in fact istihsan of hidden qiyas. When considered that istihsan of hidden qıyas is qıyas, reason (illet) of qıyas prioritized is functional here, because the strength and weakness of reason is determinant the part of being preferred of qiyas or istihsan. In this study analysis of 11 samples where qıyas is prioritized to istihsan was conducted and in these samples, quality of qiyas (wachu'l-qiyas), quality of istihsan (wachu'l-istihsan) and the reasons for being preferred of qıyas were described. The researchers can also found the way that istihsan is obligatorily evidence, and theses and antitheses of the schools accept or not this in this study. | en_US |
