dc.description.abstractBu çalışma, bütüncül bir bakışla Osmanlı Hukukunda vekalet sözleşmesini ele almıştır. Çalışma bu yönüyle alanda ilk olma özelliğini taşımaktadır. Çalışma oluşturulurken, Osmanlı hukukunun uygulama sahasını gösteren kadı kararlarından, fetva mecmualarından ve Osmanlı arşiv kayıtlarından yararlanılmıştır. Çalışmada modern hukuk sistematiği uygulanmıştır. Bu bağlamda konu iki ana kısımda genel ve özel olacak şekilde ayırıma tabi tutulmuştur. Çalışma iki bölümden oluşmaktadır. Birinci bölümde vekalet sözleşmesinin genel hükümleri incelenmiştir. Vekalet sözleşmesinin genel hükümlerinde vekalet sözleşmesinin kurulması, vekalet sözleşmesinin tarafları ve borçları, vekalet sözleşmesinin unsurları, vekalet sözleşmesinin benzer hukuki işlemlerle mukayesesi incelenmiştir. Bunun yanında, kadınların, kölelerin ve Osmanlı devletinde yaşayan gayri müslim tebaa olan zimmilerin özel durumlarına değinilmiştir. Ayrıca Roma, İslam ve Türk hukukunda vekalet sözleşmesinin bir mukayesesi yapılmıştır. Birinci bölümde son olarak vekalet sözleşmesinin sona erme halleri incelenmiştir. Çalışmanın ikinci bölümü, vekalet sözleşmesinin Osmanlı hukukundaki uygulanış şekilleri oluşturmaktadır. Osmanlılar, vekalet sözleşmesini özel uygulama şekillerine ayırarak ele almışlardır. Bu kapsamda çalışmada da bu ayırım esas alınmıştır. Bu bölümde ilk olarak, evlenmeye vekalet konusu işlenmiştir. Satın alma ve satım işlemlerine vekalet konuları uygulamadan örneklerle ele alınmıştır. Ayrıca şirketler hukukunda uygulanan vekalet türleri ele alınmıştır. Son olarak vekalet sözleşmesinin günümüze uzandığı şekilde husumete vekalet ve bu konunun mahkemelerdeki görünümü olan dava vekilliği konusu işlenmiştir. Bu çalışmada vekalet sözleşmesinin Osmanlı Hukuku’nda sık başvurulan bir hukuki işlem olduğu ve bilhassa kadınların kendilerini vekiller aracılığıyla mahkemelerde temsil ettirdikleri sonuçlarına ulaşılmıştır.en_US
dc.description.abstractThis study deals with a proxy agreement in Ottoman Law with a holistic view. With this aspect, the study is the first in the field. During the creation of the study, kadi sicils, fatwa mecmuas and Ottoman archive records showing the application area of Ottoman law were used. In this study, modern legal systematic is applied. In this context, the subject has been divided into two main parts as general and specific. In the first section, the general provisions of the power of attorney are examined. Establishment of a proxy agreement in the general provisions of the power of attorney contract, the parties and debts of the power of attorney, the elements of the power of attorney, the comparison of the power of attorney with similar legal transactions have been examined. n addition, special cases of women, slaves and Zimmi (non-Muslim subjects living in the Ottoman state) were mentioned. In addition, the Roman, Islamic and Turkish law is a comparison of the power of attorney. In the first section, the expiry states of the power of attorney were examined. The second part of the study forms the forms of implementation of the power of attorney in Ottoman law. The Ottomans discussed the power of attorney by dividing them into specific forms of implementation. In this context, the study is based on this distinction. Fırstly the issue of proxy to marry has examined. The procurement procedures, which is the term of contract, are discussed in terms of attorneyship status and procurement procedures. In this context, the subject is tried to be explained with examples. In addition, the types of power of attorney applied in corporate law are discussed. Lastly, the subject of attorney's power of attorney to the present day, the power of attorney and the appearance of this issue in the court case has been discussed.
