dc.description.abstractKüçük yaşta evlilik yapılmasına izin veren veya İslam dininin aile hukuku ile ilgili hükümlerini tenkit eden kesimlerin genel itibariyle iddialarını Talâk suresinin 4. âyetine dayandırma gayreti içinde olduklarını görmekteyiz. Bu çalışmanın amacı "küçük yaşta evlilik" meselesiyle ilgili sürekli dile getirilen söz konusu âyetin tefsir tarih boyunca nasıl anlaşıldığını tespit etmektir. Dolayısıyla bu çalışmanın amacı söz konusu âyetin sahih bir şekilde anlaşılmasına katkı sağlamaktır. Söz konusu âyetle ilgili ilk dönem tefsir ve fıkıh kaynaklarından başlayarak son döneme kadar yazılan birçok tefsir ve fıkıh kaynaklarını taradık. Âyette geçen "âdet görmeyenler" ifâdesiyle herhangi bir yaş sınırlandırılması söz konusu değildir. Dolayısıyla söz konusu âyette geçen "âdet görmeyenler" ifadesini "sadece küçükler" şeklindeki bir kayıttan ziyade en genel şekliyle ele almak en doğru yol olacaktır. Sonuç olarak Kur'an'da küçüklerin nikâhı ve talâkı hakkında herhangi bir âyet mevcut değildir. Lakin iddetleri hakkında bir âyet mevcuttur. İddetin olabilmesi için cinsi münasebet veya halvet-i sahîha olması gerekir. Bu da fasit olan bir nikâhta ya da şüpheli bir durumda tasavvur edilebilir. Kur'ân, mevcut bir problem olma hasebiyle bu konuya temas etmiştir. Dolayısıyla Kur'ân'da evlilik yaşı ile ilgili olarak sarih bir düzenleme gelmemiştir. Bu konu toplum içerisindeki şartların gelişimine bırakılmıştır. Küçük yaşta evlilik konusunu bu bağlamda değerlendirmek daha sağlıklı ve bilimsel bir yaklaşım olacaktır.en_US
dc.description.abstractWe are seeing that the section of the people who criticize islamic law on juvenile marriage (marriage at young age) or islamic family law in general trying to endeavor their claims based on surah talaq verse 4. The aim of this study is to determine how the interpretation of the "juvenile marriage" ("marriage at young age") verse has been understood throughout the commentary history (tefsir tarihi). Therefore, this study is to contribute to a clear understanding of the verse in question. We have researched many written sources about the verse in question from the commentary (tefsir) and canon law (fikih) starting from the first period until the end period. The phrase of "amenorrhoea" (absence of menstruation) that mentioned in the verse does not make any age limit. As a result, there are no verses in the Quran about the juvenile marriage and divorce. But there is a verse about period of delay (iddah). For the delay (iddah) to happen there has to be a sexual intercourse or suitable seclusion.This can be envisioned in a viciout marriage or suspiciouse situations.The Quran has touched this topic (issue) because of any existing problem. Therefore, there was no authentic arrangement in the Quran about the marital age. This topic has been left to the development of the conditions within the community. İt would be a healthier and scientific approach to consider the juvenile marriage topic (issue) in this context.en_US
