| dc.description.abstract | Islah, tecdid, ictihad ve taklit gibi konulardaki görüşleriyle meşhur son dönem İslam hukukçularından biri olan Mahmûd Şeltût'un hayatı, eserleri ve fıkıh düşüncesinin incelendiği bu çalışma giriş, üç bölüm ve sonuç kısımlarından oluşmaktadır. Giriş bölümünde araştırmanın konu, önem, kapsam, gaye ve kaynaklarından bahsedilmiştir. Birinci bölümde Şeltût'un yaşadığı dönemin siyasi, sosyal ve dini durumu hakkında bilgi verilmiştir. Ayrıca onun hayatı, ilmî tahsili ve eserleri üzerinde durulmuştur. İkinci bölümünde Mahmûd Şeltût'un usûl-i fıkıh kapsamındaki meseleler arasında bulunan şer'î delillere dair bakış açısı, Kur'ân, sünnet, icmâ, kıyas gibi delillere yaklaşımı ile ictihad, taklit ve ulemanın ihtilaf sebepleri konularındaki düşünceleri üzerinde durulmuştur. Çalışmanın son bölümde ise Şeltût'un genel olarak fürû-i fıkıh meselelerine dair yaklaşımı, sorulan sorulara verdiği fetvâları, tercihleri ve ictihadları ele alınıp ilgili düşünceleri sebebiyle İslâm hukuk tarihinde durduğu konum üzerinde durulmuştur. Sonuç kısmında ise araştırma neticesinde elde edilen bilgiler maddeler halinde serdedilmiştir. | en_US |
| dc.description.abstract | This study examines the works and fiqh thoughts of Mahmud Shaltut who is known to be last periods Islamic jurists, and well-known for his thoughts on the issues such as Islah, Tajdid and Taklid; thus, the study kick out with introduction and consist with three chapters and conclusion. In the introduction, the subject, importance, scope, objectives and sources of the study are mentioned. The first chapter discusses about the political, social and religious structures of the periods in which Shaltut lived. In addition to that, his life, education and scholarly works are emphasized. The second chapter analysis of the issues lie within the scope of Usull fiqh; whereas Mahmud Shaltut views on the Ijtihad, Taklid and controversial issues among the Scholars on the light of an evidential approach of the Shari'ah such as Qur'an, Sunnah, Ijmah and Qiyas are discussed. The last part of the study generally emphasizes on Sheltut's approach to the issues of fiqh, his fatwas given to the questions asked, ijtihad and his preferences for the issues. Further his position in the history of Islamic law based on his concerned are discussed accordingly. The study concludes by presenting the findings of the study in sequences. | en_US |
