dc.description.abstractHicri ikinci asrın başlarında İmam Şafi'nin er-Risale adlı ilk usulü eserini telif etmesiyle birlikte fıkıh alanındaki çalışmalar yeni bir ivme kazanmıştır. Yeni usul eserlerinin telifiyle beraber fukaha ve metekelimin metotları oluşmaya başlamış ve hicri dördüncü asra gelince fıkıh usulü ilmi sistematik hale gelmiştir. Tezimizin amacı Maliki mezhebi özelinde fıkıh usulü ilminin sistematik döneminde kullanılan "İstihsan" kavramının, usul ilmi nazariyatı henüz ortaya çıkmamışken el-Müdevvene çerçevesinde ilk dönem furü eserlerinde nasıl ve ne sıklıkla kullanıldığına tanıklık etmektedir. Çalışmanın hedef ise Maliki mezhebinin temel kaynağı el-Müdevvene'de uygulanışına dair örneklerden hareketle İstihsanın mezhebin fıkıh geleneğinde kullanım sıklığının ve biçimini ortaya koymaktır. Çalışmayı diğerlerinden farklı kılan en önemli özelliği fıkıh usulü nazariyatının henüz kavramsallaişmadığı dönemde kullanılan yöntemlerin uygulanışını somut örneklerle ortaya koyması ve bunu yaparken de ülkemde ( Fildişi Sahilleri) fazla çalışmamış bir mezhebi konu edinmiş olmasıdır.en_US
dc.description.abstractImam Shafi's first work, er-Risale, at the beginning of the second century of the Hijri, gives a new value by copyright. With the reconciliation of the new method, fuqaha and metekelimin started to form, and as a Hijri method, the science of fiqh became unraveled before the beginning. How and when the selection of al-Mudawwana ended in the first period furu instruments, when the methodological theory of the concept of "Istihsan", which is used in the system of the science of fiqh method specifically for the purpose of our thesis, was not yet emerging. The main sources of the targeted malik sect of the study, the application of al-Mudaw, can be given as an example from the language of the sect and the sect of istihsan, based on the examples. It cannot be demonstrated with examples that can be applied in the case where the selection is not yet valid with the selection of the most important feature that can be applied.en_US
