dc.description.abstractBu araştırma Osmanlı ilmiye sınıfına mensup olan ve Kıbrıs'ta İngiliz sömürgesinin hâkim olduğu yıllarda eğitim, yargı ve din alanlarında hizmet vermiş bulunan Hürremzâde Mehmet Hakkı Efendi'nin hayatı, eğitimi ve Fetva Eminliği döneminde verdiği fetvalardan erişebildiklerimizin transkripsiyon ve İslam Hukuku açısından incelenmesini içermektedir. Kıbrıs'ta İngiliz idaresi tarafından atanan ilk müftü olan Hakkı Efendi bu atama ve sonrasında icra ettiği Fetva Eminliği nedeniyle Kıbrıs Türkleri nezdinde çeşitli eleştirilere maruz kalmıştır. Adada Fetva Eminliğinin öncesinde çeşitli görevleri de icra eden Hakkı Efendi'nin yalnızca Fetva Eminliği döneminden erişebildiğimiz (1929-1930-1946-1947-1948) 752 adet fetvasının ele alındığı bu çalışmada Hakkı Efendi'nin kadılık dönemine ait tutanakları ve müftülük dönemine ait fetvaları araştırma dışında bırakılmıştır. Çalışmanın ilk bölümünde Osmanlı Devleti döneminde adanın idari yapılanması ve genel durumu ile Hakkı Efendi'nin yaşadığı İngiliz dönemi Kıbrıs'ının idari yapılanması ve genel durumu ele alınmıştır. İkinci bölümde; eriştiğimiz fetvalar monografik örneklem şeklinde okura sunulmuştur. Yine bu bölümde; kullanılan fetvaların tarihleri, hangi deftere ait oldukları ve fetvalarda müracaat edilen atıfların geçtiği yerler dipnotlarda gösterilmiştir. Fetva usulü hakkında kısa bir girişle başlayan üçüncü bölümde ise Hakkı Efendi'nin fetvalarından ilgi çekici olanları İslam hukuku açısından irdelenmiştir. Ayrıca burada; müracaat ettiği kaynaklar değerlendirmeye alınmış ve atıf yapılan kaynaklar muteberlik yönünden incelenmiştir. Yine bu bölümde elimizdeki fetvalardan sosyal içerik noktasında ilgi çekenler değerlendirilmeye çalışılmıştır. Çalışmanın sonucunda Kıbrıs'ta İngiliz idaresi döneminde Fetva Eminliği gibi son derece kritik bir görevi icra eden Hakkı Efendi'nin görevinin gerektirdiği vasıfları haiz olduğu ve verdiği fetvaların İslam hukuk disiplini açısından muteber olduğu tespit edilmiştir.en_US
dc.description.abstractThis research studies the life and education of Hürremzâde Mehmet Hakki Efendi, who was a member of the Ottoman scolarly "ilmiye" class and served in the fields of education, judiciary and religion during the era of British colonial rule in Cyprus, in terms of transcription and Islamic Law. Hakki Efendi, who was the first mufti appointed by the British administration in Cyprus, was subject to various criticisms by the Turkish Cypriots due to this appointment and the trustee off Fatwa he performed afterwards. In this study, 752 fatwas of Hakki Efendi, who also performed various duties before the Fatwa Trustee on the island, which can be accessed only from the Fatwa Trustee period (1929-1930-1946-1947-1948), are investigated, the time of Hakki Efendi's tenure in the judiciary and the fatwas belonging to the mufti period have has been ignored. In the first part of the study, the administrative structure and general situation of the island during the Ottoman Empire period and the administrative structure and general situation of Cyprus during the British period, where Hakkı Efendi lived, are discussed. In the second part; the fatwas we have accessed are presented to the reader in the form of a monographic sample. Again in this part; the dates of the fatwas used, the notebook they belong to and the places where the references applied in the fatwas are shown in the footnotes. In the third chapter, which starts with a short introduction about the method of fatwa, interesting ones among Hakki Efendi's fatwas are examined in terms of Islamic law. Also here; the sources he referred to were evaluated and the referenced sources were examined in terms of validity. Again in this part, the ones that most attracted in terms of social content among the fatwas we have were tried to be evaluated. As a result of the study, it has been determined that Hakkı Efendi, who performed an extremely critical task such as the Cyprus Fatwa trustee during the British administration, had the qualifications required for his duty and the fatwas he gave were valid in terms of Islamic law discipline.en_US
