dc.description.abstractİslam Hukuku’nun teşekkül döneminde yer alan iki fakihten Ebû Hanîfe ve İbn Ebî Leylâ her ikisi de Kûfe’de yaşamışlardır. İki müçtehit arasında çeşitli sebeplerden dolayı ihtilaflar meydana gelmiştir. İhtilafların değerlendirilebilmesi için iki müçtehidin hayatları ve yöntemlerinin bilinmesi gerekmektedir. Araştırmamızda iki müçtehidin kısaca hayatlarını, fetva verirken kullandıkları yöntemleri, özellikle müntesibi kalmayan İbn Ebî Leylâ‘nın ulaşabildiğimiz görüşlerinden hareketle usül yöntemlerini çıkarmaya çalıştık. İki müçtehidin ihtilaf ettikleri füru meselelerini tespit edip dayandıkları delilleri aktararak kısa değerlendirmeler yaptık. Araştırmamızı giriş ve iki bölüm şeklinde gerçekleştirip giriş bölümünde konunun teorik alt yapısını oluşturmayı amaçladık. Birinci bölümde Ebû Hanife ve İbn Ebî Leylâ’nın kısaca hayatlarını, “İhtilaf-ı Ebî Hanife ve İbni Ebî Leylâ” kitabını inceledik. İkinci bölümde Ebû Hanife ve İbn Ebî Leylâ’nın ibadetler, muamelat, ukubât konularında ihtilaf ettikleri konuları tespit edip dayandıkları delilleri aktarıp kısaca değerlendirmeler yaptık. Sonuç kısmında ise araştırma sebebiyle zihnimizde oluşan kanaati maddeler halinde ifade etmeye gayret ettik.en_US
dc.description.abstractTwo of the scholars, both Ebû Hanîfe and İbn Ebî Leylâ who had lived in Kûfe, took part in the formation of İslamic Law. There had been conflicts between two scholar because of several reasons. İn order to evaluate these conflicts, it should be known both their lives and methods. İn our research, we managed to find out the manners based on the ways that while they were giving fatwa especially İbn Ebî Leylâ’s attainable opinions; however she hadn’t had any followers. We assessed brief evalautions according to the evidences that two scholars had disagreement about subtitles. Having composed the research as introduction and two other parts, in introduction part we intented to from of the theoretical substructure of the topic. İn the first part, we analyzed the lives and the books of Ebî Hanife and İbni Ebî Leylâ briefly. İn the second part our research, having itentified the diasagreement topics such as worships, proceedings and punishments of Ebû Hanîfe and İbn Ebî Leylâ, we evaluated them in short. As a conclusion, we tried to clarify our opinion in headlines at the end of the research.en_US
