dc.description.abstract	On dokuzuncu yüzyılın sonlarına doğru ortaya çıkan kredi kartları, klasik dönem fukahâsının karşılaşmadığı yeni bir meseledir. Bu çalışmada kredi kartları sisteminin işleyişi, kredi kartının altı tarafı arasındaki ilişkinin fıkhî niteliği ve hükümleri değerlendirilmiştir. Çalışma, bir giriş ve üç bölümden oluşmaktadır. Giriş bölümünde çalışmanın konusu, önemi, amacı; meselelerin irdelenme yöntemi ve kaynaklarına dair bilgilere yer verilmiştir. Birinci bölümde kredi kartının kavramsal çerçevesi, ortaya çıkışı ve tarihsel gelişimi, kredi kartları ve benzeri kart türleri, ülkemizde BKM’nin kuruluşu ve kredi kartı sisteminin işleyişi ele alınmıştır. İkinci bölümde kredi kartının altı tarafı arasındaki ilişkinin fıkhî durumu tespit edilmeye çalışılmıştır. Buna göre kart çıkaran kuruluş ile kart hamili, kart çıkaran kuruluş ile üye işyeri, kart hamili ile üye işyeri, üye işyeri anlaşması yapan kuruluş ile üye işyeri, üye işyeri anlaşması yapan kuruluş ile kart çıkaran kuruluş ve kartlı sistem kuruluşları ile üye kuruluşlar arasındaki ilişkilerin fıkhî temellendirilmesi araştırmaya tabi tutulmuştur. Üçüncü ve son bölümde ise İslam hukukunun akid teorisine göre kredi kartları için yapılan işlemlerin veya bu kartlarla işlem yapılması sonucunda doğan hükümler incelenmiştir. Çalışma, varılan neticeleri ve önerileri içeren bir sonuç bölümüyle tamamlanmıştır.
dc.description.abstract	Credit cards emerged towards the end of the nineteenth century, posing a new issue that the jurists of the classical period had not encountered before. This study evaluates the functioning of the credit card system, the jurisprudential nature of the relationship between the six parties involved, and its provisions. The study consists of an introduction and three chapters. The introduction provides the subject, importance, and purpose of the study, the method for analyzing the issues, and the sources of the study. The first chapter discusses the conceptual framework of the credit card, its emergence and historical development, various types of credit cards, the establishment of the BKM (Interbank Card Center) in our country, and the operation of the credit card system. The second chapter aims to determine the jurisprudential status of the relationship between the six parties involved in a credit card. Consequently, we have examined the jurisprudential foundation of the connections among the issuer and the card holder, the acquirer and the merchant, the acquirer and the issuer, the network operator, and the member institutions. The third and final part analyzed the provisions arising from credit card transactions or transactions made with these cards using the contract theory of Islamic law. A concluding chapter, containing conclusions and recommendations, concluded the study.
