dc.description.abstractBir toplumun sağlamlığı, o toplumun temelini oluşturan ailelerin sağlamlığına bağlıdır. Aile içindeki üyeler arasındaki sadakat ve samimiyet, gelecek nesillerin teminatını oluşturur. Eğer bu sadakat ve samimiyet kaybolursa, bu durum ailede yetişen çocukların geleceğini de olumsuz şekilde etkileyebilir. İnsanların hayatlarını inanca devam edilebilmesi için vazgeçilmez temel haklar olarak bilinen can, mal ve ırzın himaye edilmesi gerekir. Bu kural hemen hemen bütün hukuk sistemlerinin esasını oluşturmuştur. Bu haklara haksız tecavüzde bulunanlar, farklı şekillerde de olsa bütün hukuk sistemlerinde cezalandırılmış, haksız tecavüzde bulunan kimseler, toplum tarafından da kınanmıştır. İşte bu noktadan hareketle, diğer suçlara nazaran ahlâka aykırı fiillere verilen cezalar daha ağır olmuştur. Diğer hukuk sistemlerinde olduğu gibi İslam hukukunda da konulmuş olan hükümler, insanların menfaatlerini gözetmiş ve onların en iyi bir şekilde hayatlarını devam etmesini hedef almıştır. Günümüzde Afganistan'da ceza kanunu da diğer kanunlar gibi İslam hukukuna uygun bir şekilde hazırlanmıştır. Bu bağlamda biz Afganistan ceza kanununda yer alan cinsel suçların neler olduğunu tez konusu olarak inceledik. Afgan ceza hukuku içerisinde yer alan cinsel suçların neler olduğunu incelerken de Hanefî mezhebinin görüşlerini esas aldık.en_US
dc.description.abstractThe strength of a society depends on the strength of the families that form the foundation of that society. Loyalty and sincerity among the family members are the guarantee of future generations. If the loyalty and sincerity are lost, it can negatively affect the future of the children growing up in the family. People, in order to continue to live their lives based on faith; human life, property, and honor must be protected, which are known as indispensable fundamental rights. This rule has formed the basis of almost all legal systems. Those who unjustly violate these rights, albeit in different ways they are being punished in all legal systems, and those who commit unjust violations are condemned by society as well. From this point of view, the penalties for acts against morality have been more severe than other types of crimes. As in other legal systems, the provisions of Islamic law are based on the interests of the people and aim to ensure that they live their lives in the best possible way. Today, the penal code in Afghanistan, like other laws, has been prepared in accordance with Islamic law. In this context, we examined the sexual crimes in the Afghanistan penal code as a thesis topic. While examining the sexual crimes in the Afghan penal code, we took the views of the Hanafi madhhab as a basis.en_US
