Özet
Özelleştirme, devletin vazife ve işlemlerinin imkân ölçüsünde en aza indirilmesi, özel kesime devredilmesidir. İslam Hukukunda ihyâü'l-mevât, iktâ' ve vakıf müesseseleri gibi konular birer özelleştirme benzeri uygulamalar olmanın yanında, iktisadî canlılık ve kalkınmanın önemli fırsatları olmuşlardır. Ülkenin mamur hâle gelmesindeki yöntemlerden biri olan bu uygulamalar, kişilere şahsi teşebbüs hürriyeti ve ferdî ekonomik refah kazandıran önemli uygulamalardır. Bunlar, günümüzdeki özelleştirme uygulamaları ile birebir örtüşmese de kamu malının imar ve ihya etmeleri için özel kişi ve sektörlere tahsisi, bu varlıkların bazılarına karşılıksız olarak verilmesi bir çeşit özelleştirme olarak değerlendirilebilir. İslam iktisadında devlet, özel teşebbüsleri engellemediği gibi eğitim, teftiş, emniyet, gözetim ve düzenleme görevleriyle onları sürekli üretime teşvik eder. Ekonomide millileşme faaliyetlerinin artırılması için İslam ülkelerinin asli unsuru olan Müslüman girişimciler özellikle teşvik edilmeli ve bunun tüm halk tabanına ulaştırılması hedeflenmelidir. Millî menfaatler gözetilerek, stratejik alanların yabancıların eline geçmemesi için gerekli tedbirlerin alınması gerekir. Devlet tekeline son verme adına, özel sektör tekeline de yol açılmamalıdır. Kur'ân'ın ifadesi ile "zenginler arasında dolaşan" bir servet hâlini almamalıdır. Haksız bir zengin tabakanın oluşmasına meydan verilmemelidir. Sermayeyi tabana yaymak için devlet, vatandaşlarına her türlü kolaylığı sağlamalı ve destek olmalıdır. İşletim hakkının farklı yöntemlerle özel kişi ve sektörlere devri yapılsa da bunların devletin malı olarak kalmasının kamu menfaatine daha uygun olacağı söylenebilir. Bununla birlikte kamu sektörü ile özel sektör bir araya gelerek, sermaye emek ortaklığı (mudarebe), arazi ziraat ve tarım ortaklıkları (muzaraa) gibi birçok şirket kurarak el birliği ile ekonomik kalkınmaya ivme kazandırılabilir.
Privatization means minimizing the duties and operations of the state to the extent possible and transferring them to the private sector. In Islamic Law, subjects such as ihyâü'l-mevât, iktâ' and foundation institutions are not only Privatization-like practices, but also important opportunities for economic vitality and development. These practices, which are one of the methods for the country to become prosperous, are important practices that provide people with personal freedom of enterprise and individual economic prosperity. Although these do not coincide exactly with today's privatization practices, the allocation of public property to private individuals and sectors for their development and revival, and the giving of some of these assets free of charge, can be considered a kind of privatization. In Islamic economics, the state does not prevent private enterprises, but also encourages them to continue production through its education, inspection, security, surveillance and regulation duties. In order to increase nationalization activities in the economy, Muslim entrepreneurs, who are the essential elements of Islamic countries, should be especially encouraged and it should be aimed to reach the entire public base. Considering national interests, necessary precautions must be taken to prevent strategic areas from falling into the hands of foreigners. In the name of ending state monopoly, private sector monopoly should not be created. It should not become wealth that "circulates among the rich", as the Quran puts it. The formation of an unfair rich layer should not be allowed. In order to spread the capital to the base, the state must provide all kinds of facilities and support to its citizens. Even though operating rights are transferred to private individuals and sectors through different methods, it can be said that it would be more in line with the public interest if they remain the property of the state. In addition, the public sector and the private sector can come together and accelerate economic development by establishing many companies such as capital-labor partnerships (mudaraba), land agriculture and agricultural partnerships (muzaraa).
