| dc.description.abstract | Hibe akdi, bir malın bedelsiz olarak karşı tarafın mülkiyetine geçirilmesini ifade eder. Bu araştırmada, hibe konusundaki fıkhî görüşler Somali Medeni Kanunu ile mukayeseli olarak çalışılacaktır. Hibe konusunda mezheplerin görüşleri incelenecek, ittifakları, ihtilafları ve Somali medeni kanunu ile mukayesesi üzerinde durulacaktır. Bu çerçevede, İslam Hukuku mezheplerine ait temel kaynaklardaki görüşlere müracaat edilecektir. Söz konusu eserlerde konunun kapsamlı olarak ele alınması sebebiyle araştırmanın çerçevesi hibenin tanımı, rükünleri, şartları ve hibeden rücu ve ivazlı hibe ile sınırlı tutulacaktır. Çalışmamız bir giriş, iki ana başlık ve sonuçtan oluşmaktadır. İlk bölümde hibenin tanımı, nitelikleri, hükümleri, çeşitleri, rükünleri ve şartları ele alınacaktır. İkinci bölümde ise hibenin sona ermesi, hibeden rücu ve rücu engelleri konularına temas edilecektir. Hibeye dair fıkhi hükümler, Somali Medeni Kanunuyla mukayeseli olarak inceleneceği için, Somali'de yaygın mezhep olan Şafii mezhebi hükümleri üzerinde özellikle durulacaktır. Ayrıca araştırmamızın giriş kısmında Somali'nin tarihi, hukuku ve medeni kanunundan kısaca bahsedilecektir. | en_US |
| dc.description.abstract | Donation agreements refer to the transfer of a good free of charge to the property of the other party. In this study, legal opinions on donation will be studied in comparison with the Civil Code of Somalia. The views of the Islamic schools of law regarding donation contract will be examined and its comparison with the Somali civil law will be emphasized. In this context, views in the main sources of Islamic Law schools will be consulted. Since the subject is handled comprehensively in these works, the framework of the research will be limited to the definition of donations, its provisions, conditions, recourse from donation and onerous donations. Our study consists of an introduction, two main chapters and a conclusion. In the first chapter, the definition, qualifications, provisions, types and conditions of donations will be discussed. In the second chapter, the termination of a donation, recourse from donation and its barriers will be discussed. Since legal provisions on donations will be examined in comparison with the Civil Code of Somalia, special emphasis will be placed on the Shafii school of law, which is the common school in Somalia. In addition, Somalia's history, law system and its civil law will be briefly mentioned in the introduction of our research. | en_US |
