dc.description.abstractSahâbî kavli, yıllarca Hz. Peygamber'in en yakınında bulunan ve vahiy sürecinin tamamına şahitlik eden sahâbenin fıkhî görüşleridir. Sahâbî kavli, fıkıh usûlü ile ilgili ilk yazılan eserlerden itibaren kendisinden söz edilen ve çoğu zaman müstakil başlıklarda ele alınan bir konudur. Farklı mezheplere ait usul kitaplarında konuyla ilgili en önemli tartışma, onun hücciyeti hakkındadır. Bu eserlerde sözünün delil değeri tartışılan sahâbî de, fıkhî bilgisiyle ön plana çıkmış olan sahâbîdir. Bu çalışmada sahâbî kavli konusu, dört mezhep özelinde incelenmiştir. Çalışmamızda, bu mezheplere mensup usulcülerin, onun delil olması hakkındaki görüşleri tespit edilmiştir. Bunun yanında, usulcülerin görüşlerini esas alarak meşhur dört mezhebin kurucu imamlarının konuyla ilgili kanaatleri de belirlenmiştir. Yaptığımız bu çalışma bir giriş, üç bölüm ve bir sonuçtan meydana gelmektedir. Giriş bölümünde çalışmanın konusu, önemi, amacı, kaynakları, daha önce yapılan çalışmalar ve görüşünün hüccet olması bakımından sahâbe neslinin önemi, üzerinde durulmuştur. Birinci bölümde, konuyla ilgili kavramlar incelenmiş, meşhur dört mezhep usulcülerinin sahâbî kavline bakışı kronolojik olarak ele alınmıştır. Bununla birlikte, sahâbî kavli-hadis ilişkisi, sahâbî fetvasının kıyasa takdimi ve onun umumu tahsisi konularına da bu bölümde yer verilmiştir. İkinci bölümde,sahâbî kavlinin çeşitleri, onu hüccet olarak kabul eden usulcülerle kabul etmeyenlerin dayandıkları deliller incelenmiştir. Üçüncü bölümde, fürûdan sahâbî kavline dayanan bazı fıkhî meselelerle ilgili örnekler ele alınmıştır. Araştırmamız neticesinde ulaştığımız sonuçların yer aldığı "Sonuç" bölümü ile, çalışmamız tamamlanmıştır.en_US
dc.description.abstractCompanion view is the fiqh views of the companions, who were closest to Prophet Muhammad and witnessed the entire process of revelation for many years. The Companion view is a subject that has been mentioned since the first works written on the islamic jurisprudence and is often discussed under separate headings. The most important discussion on the subject in the islamic jurisprudence books of different sects is about its being argument. The companion whose evidential value of view is discussed in these works is also the companion who prominent with his knowledge of fiqh. In this study, the subject of companion view has been studied in terms of four sects. In our study, the views of the methodologists belonging to these sects about its being argument have been determined. In addition, the opinions of the founder imams of the four famous sects on the subject were determined based on the opinions of the methodologists. This study consists of an introduction, three chapters and a conclusion. In the first chapter, the concepts related to the subject are examined, and the view of the four famous sect methodologists to the companion view is discussed chronologically. Besides, the relationship between the Companion view and hadith, the presentation of the Companion's fatwa to the qiyas and specialization of general are also included in this section. In the second chapter, the types of the companion view, the evidences of those who accept it as argument and those who do not accept it, are examined. In the third chapter, examples related to some fiqh issues based on the opinion of the companions from the furû are discussed. Our study has been completed with the "Conclusion" section, which includes the results we reached as a result of our research.en_US
