dc.description.abstractGünümüzde oldukça artış göstermiş olan ve toplumda karşılaşılan en önemli sorunlardan birini oluşturan çocukların cinsel istismarı vakaları, çocuk istismarı tipleri arasında en ağırı ve tespit edilmesi en zor olanıdır. Bu çalışmada "çocukların cinsel istismarı" kavramsal ve hukuki açıdan ayrıntılı olarak ele alınmış, yasa düzenlemesinden ve uygulamadan kaynaklı sorunlar ön plana çıkartılmış, öğretide ileri sürülen görüşler de dikkate alınarak çözüme yönelik değerlendirmeler yapılmıştır. Çalışmada öncelikle çocukların cinsel istismarına ilişkin temel kavramlar, uluslararası düzenlemeler; cinsel istismar suçunun tarihi görünümü, 765 sayılı Türk Ceza Kanunu’ndaki karşılığı ve benzer suçlarla mukayesesi konularına yer verilmiştir. İkinci bölümde 5237 sayılı Türk Ceza Kanunu’nun 103. maddesinde düzenlenen çocukların cinsel istismarı suçunun unsurları, nitelikli halleri ve netice sebebiyle ağırlaşan hallerinden bahsedilmiştir. Son bölümde ise suçun özel görünüş şekilleri, soruşturma ve kovuşturma usulü ile suçun yaptırımı konularına değinilerek çalışma tamamlanmıştır. Çocukların cinsel istismarı suçu ile ilgili tartışmalı birçok husus bulunmakla birlikte üzerinde durulması gereken en önemli hususlar; suçun her iki tarafının da çocuk olması, evlenme ile reşit hale gelen çocuğa karşı eş tarafından zorla gerçekleştirilen cinsel eylemler, failin kadın veya eşcinsel bir erkek olması, yasal evlenme yaşının altındaki fiili evliliklerde tarafların ve taraf ebeveynlerinin durumu ile suç failine kastrasyon uygulanması tartışmasıdır.en_US
dc.description.abstractCases of sexual abuse of children, which have increased considerably today and constitute one of the most important problems encountered in society, are the most severe and difficult to detect among the types of child abuse. In this study, "child sexual abuse" has been discussed in detail in terms of conceptual and legal aspects, problems arising from the regulation and implementation of the law have been brought to the fore, and solutions have been evaluated by taking into account the views put forward in the doctrine. In the study, primarily the basic concepts of child sexual abuse, international regulations; The historical appearance of the crime of sexual abuse, its equivalent in the Turkish Penal Code No. 765 and its comparison with similar crimes are included. In the second part, the elements of the crime of sexual abuse of children regulated in Article 103 of the Turkish Penal Code No. 5237, its qualified situations and the aggravated situations due to the result are mentioned. In the last part, the study was completed by mentioning the special appearance of the crime, the investigation and prosecution procedure and the sanction of the crime. Although there are many controversial issues regarding the crime of sexual abuse of children, the most important issues to be considered are; both parties of the crime are children, sexual acts committed by the spouse against the child who has reached the age of majority by marriage, whether the perpetrator is a woman or a homosexual man, the situation of the parties and the parents of the parties in actual marriages under the legal marriage age, and the application of castration to the perpetrator of the crime.en_US
