dc.description.abstractBu tez çalışmasında, ceza muhakemesinde ispata, kabul edilen ilkelere ve delillere ilişkin genel bir açıklama yapılmıştır. Geçmişten bugüne tartışılan bir beyan delili olan sanığın ikrarı, delil değeri açısından incelenmiştir. İkrarın güvenilirliğinin araştırılması için belirlenen kriterler açıklanmış ve tartışılmıştır. Suçsuzluk karinesi gereğince sanığın ispat külfeti olmamasına rağmen ikrar ederek yargılamaya sunduğu katkının sonuçları değerlendirilmiştir. Bu sebeple ilk bölümde ispata ve delillere yer verilmiş, ikinci bölümde ise kapsamlı olarak ikrar delili açıklanmıştır. Çalışmanın amacı ikrarın güvenilirliğinin sağlanması ve delil değerinin tespit edilmesi için yetkili makamların uygulamadaki çözümlerine yer vererek, naçizane görüşler ve öneriler sunmaktır.en_US
dc.description.abstractIn this thesis, a general explanation of proof, accepted principles and evidence in criminal procedure has been made. The confession of the accused, which is a statement and evidence that has been discussed from the past to the present, has been examined in terms of evidential value. Despite the fact that the accused does not have the burden of proof in accordance with the presumption of innocence, the results of his contribution to the trial by confessing are evaluated. For this reason, in the first part, proof and evidence are included and in the second part, the proof of confession is explained comprehensively. The aim of the thesis is to provide humble opinions and suggestions by including the solutions of the competent authorities in order to ensure the reliability of the confession and to determine the evidental value.en_US
