dc.description.abstractAlacaklılar, borçlularının rızası ile ödemediği alacaklarına kavuşabilmek için cebri icra yoluna başvurmaktadır. Bu çalışma ile alacaklıların, anonim şirketlerde ortaklık payı olan borçlularına karşı başvurabileceği ve alacaklarını tahsil edebilme şekli incelenmiştir. Anonim ortaklık payı, hem malvarlığı hem de şahsa bağlı haklar içeren karma nitelikte ortaklık paylarıdır. Bu nedenle payın haczi, sadece alacaklı-borçlu ilişkisini değil, aynı zamanda şirketin işleyişini de etkileyen hukuki sonuçlar doğurur. Tezde öncelikle pay kavramı ve türleri incelenmiş, ardından payın haczi süreci ve bu sürecin hukuki etkileri anlatılmıştır. Son olarak, haczedilen payın paraya çevrilmesi süreci, uygulamada karşılaşılan sorunlar ve çözüm önerileriyle birlikte değerlendirilmiştir.
dc.description.abstractWhen debtors fail to fulfill their obligations voluntarily, creditors resort to compulsory enforcement proceedings to recover their receivables. This study analyzes the legal mechanisms available to creditors seeking to collect debts from debtors who hold partnership shares in joint stock companies, as well as the procedural aspects of enforcing such claims. A share in a joint stock company is a hybrid right that encompasses both proprietary and personal elements. Therefore, the attachment of such a share not only affects the creditor–debtor relationship but also has significant legal implications for the company’s internal structure and operations. In this thesis, the concept and types of shares are first examined, followed by an analysis of the process and legal consequences of the attachment of shares in joint stock companies. Finally, the procedures for converting attached shares into cash are evaluated, together with the practical challenges encountered in implementation and proposed solutions.
