dc.description.abstractOsmanlı Devletinin en önemli kamu görevlilerinden biri kadıdır. Günümüz hâkiminden daha geniş yetki ve görevlere sahip kadılar, Osmanlı Devletine özgü bir usulle seçilmişlerdir. Klasik dönemde kadılığa giriş için mülâzemet adı verilen sistemin uygulandığı görülmektedir. Mülâzemet sistemi, adalet camiasının dikkatini, yeterince çekmiş değildir. Bu çalışma mülâzemet sistemine günümüz penceresinden bakmaktadır. Hâkim adaylarında aranan şartlar, adayların tespit edilmesi ve adaylık süreci ele alınmıştır. Mülâzemetle ilgili tarih ve ilahiyat alanlarında çalışmalar yapılmıştır. Mülâzemet defterleri incelenmiştir. İlmiye sınıfına ve kazaskerliğe ilişkin çalışmalar da konu bakımından önemlidir. Çalışmalardaki bilgiler, hâkim adaylığı konusu açısından değerlendirilmiştir. Mülâzemet sistemi, ilmiye mensuplarını merkeze koymuştur. Hâkim olmak için en önemli şart, bir ilmiye mensubunun referansıdır. Bazı görevliler de mülâzemete girebilmiştir. Adaylarda asgari şartlar aranmış, sınav ihtiyaç olursa yapılmıştır. Sistemi düzenlemek için fermanlar hazırlandığı, ilim adamlarının eleştiriler yönelttiği görülmektedir. Mülazemet sisteminde, günümüze uyarlanabilecek usuller uygulanmıştır.en_US
dc.description.abstractOne of the most important public officials of the Ottoman State ise the kadi. The kadis have more authority and mission than the judges of today. They were determined by a method specific to the Ottoman State. In the classical period, it is seen that the system called the mulazemet is applied in order to be a kadi. The system of mulazemet has not attracted enough attention to the justice community. This study looks at the mulazemet system from the present perspective. It is discussed the conditions to be a judge candidate, election of candidates and candidacy process. Studies have been carried out in the fields of history and theology related to the mulazemet. Mulazemet books have been examined. Studies related to the ilmiye and kazasker are also important for the subject. The information in the studies was evaluated in terms of judge candidacy. The mulazemet system has put the members of ilmiye at the center. The most important condition to be a judge is the reference of a member of ilmiye. Some of the officials also entered the mulazemet system. Minimum conditions for candidacy are requested. The exam is made if needed. It appears that the scholars have been directed criticism and sultans prepared fermans to organize the system. In the mulazemet system, the procedures that can be adapted to the present have been applied.en_US
