dc.description.abstract	"Sünnî ve Şiî Tefsir Kaynaklarına Göre Hırâbe" ile ilgili bu çalışma bir giriş, iki bölüm ve sonuç kısmından meydana gelmektedir. Giriş kısmında araştırmanın konusu, önemi, amacı, sınırlandırılması, kaynakların değerlendirilmesi hakkında genel bilgiler verilmiştir. Birinci bölümde kavramsal ve hukuki bakımdan hırâbe ve bağy suçunun terim anlamları, hırâbe suçunun gerçekleşmesi için yolu kesenlere ait, yolu kesilenlere ait, hırâbe suçunda çalınan mala ait ve yol kesme olayının geçtiği yere ait aranan şartlar, hırâbe haddini düşüren şartlar ve hırâbe suçunun ispat vasıtaları temel sözlüklerden ve fakihler tarafından esas alınan Sünnî ve Şiî fıkıh kitaplarından açıklanmıştır. İkinci bölümde ise Sünnî ve Şiî tefsir kaynaklarına göre hırâbe ayetlerinin nüzul sebebi, Ureyne vâkıası ile ilişkisi, Allah ve Resûlü ile savaşma kısmının tevilleri, yeryüzünde fesat çıkarma kısmının tefsiri, hırâbe haddinin kapsamında olan suçlular, hırâbe haddinin uygulanmasındaki farklı görüşler ve hırâbe suçunda tevbenin uygulanacak cezaya etkisi olarak yeni ve eski tefsir kaynaklarına göre değerlendirilmiştir. Sonuç bölümünde ise genel bir değerlendirme yapılarak ulaşılan netice belirtilmiştir.	en_US
dc.description.abstract	The research about "Bandirty Base on Sunnah and Shiah Tafsir Sources" is consist of instruction, two sections and conculsion. The introduction part is consist of general information about the importance of subject, objective and restrictions of the subject, and evaluation of resources. In the first part, the conceptual and legal terms of the banditry and the meanings of rebellion crime. at the realization of banditry, the conditions that annihilate the punishment of bandit, conditions belong to whos way has been cut off, condition belong stolen goods, where banditry crime took place and the means that prove the banditry crime are explained base on main dictionaries and main books of jurisconsult of Sunni and Shiya In the second chapter, base on new and old Tafseer sources, the reasons of the 33 and 34 verse of Sura Al-Maida according to the Sunni and Shiite Tafsir sources, the relation with the event of Ureyne tribes, the interpretation of struggle with Allah and His Messenger, interpretation of corruption above earth, the crimes that cause of banditry punishments, the different views in the application of banditry punishments and the affects of repent on banditry punishments were evaluated. In the conclusion section, by doing a general evaluation the reached result is indicated.	en_US
