Özet
Fukaha, şer‘î nasların Şârî‘in muradına muvafık surette anlaşılmasını temin edecek muhkem kâideler tayin etmişlerdir. Bu kâideler çoğu zaman soyut ve teorik nitelikte olduğundan mahiyetleri tam olarak kavranılamamaktadır. Bunun için bu kâidelerin tatbikî surette görülmeleri büyük önem arzetmektedir. Usûlî kâidelerin tatbikinin müşahede edilebileceği eserlerin başında ahkâm hadislerinin şerhleri gelmektedir. Ahkâm hadis şerhi literatürünün en güzide ve zikrettiğimiz hedefe hizmet eden misallerinden birisi İbn Dakīkul‘îd’in İḥkâmü’l aḥkâm şerḥu ʿUmdeti’l-aḥkâm adlı eseridir. Çalışmamızda bahsettiğimiz probleme bir çözüm sunmak gayesiyle nasların tefsirinde esas alınan kâide ve esasları ‘hadis-i şeriflerin şer‘î hükme delâletleri’ cihetiyle sınırlandırmak üzere teorik ve pratik olarak ele aldık. Çalışmanın teori kısmında hadis-i şeriflerden hüküm istinbatının şartlarından biri olan ‘hükme delâletinin açık olması’ şartı çerçevesinde bu husustaki usûlî meseleleri özet halde sunduk. Pratik kısmında ise İḥkâmü’l-aḥkâm şerḥu ʿUmdeti’l-aḥkâm üzerinden teori kısmında ele aldığımız soyut haldeki usûlî meselelerin müşahhas ve tatbikî suretlerini ortaya koymaya çalıştık. Çalışmanın hedeflerinden biri de İslam ulemasının fıkhî istinbatta esas aldıkları yöntemin derinlik ve metenâtini göstermek ve bu yönteme vâkıf olmadan fıkhî istinbatın yapılamayacağını okuyucuya hissettirmektir. Ayrıca İbn Dakīkul‘îd’in ele alınan usûl konularına dair görüş ve tercihlerini tespitte çalışmanın amaçları arasındadır.
The Islamic jurists have established the rules of muhkam to ensure that the Sharī'ah's teachings are understood in accordance with the intention of the Shāri'ah. Since these rules are often abstract and theoretical in nature, their essence cannot be fully comprehended. For this reason, the practical application of these rules is of great importance. One of the most important works in which the practical application of the rules can be observed is the commentaries of ahkam hadiths. One of the most prominent examples of the literature on the commentary of ahkām ḥadīths that serves the above mentioned purpose is Ibn Daqīqul'īd's Iḥkām al-aḥkām sharḥu ʿUmdat al-aḥkām. In order to provide a solution to the problem we have mentioned in our study, we have dealt with the theoretical and practical aspects of the principles and rules based on the exegesis of the hadīths in order to limit them in terms of 'the evidentiality of the hadīths to the Sharīʿah ruling'. In the theoretical part of the study, we summarized the usūlī issues in this regard within the framework of the condition that 'the evidentiality of the hadīths to the ruling is clear', which is one of the conditions for the reveal the meaning (istinbāt) of rulings from the hadīths. In the practical part of the study, we have presented the concrete and practical forms of the abstract usūlī issues that we have discussed in the theory part through Iḥkām al-aḥkām sharḥu ʿUmd al-ʿUmdat al-aḥkām. In addition, as one of the goals of this study, we can mention showing the attention and steadiness of the methodology that Islamic scholars take as basis in fiqhī istinbāt and letting the reader know that fiqhī istinbāt cannot be performed without being familiar with this methodology.
