Özet
Kanûn-ı Esâsî ta'dillerini konu edinen ve maddelerde yapılan değişikliklerin değerlendirilmesi amaçlanan bu çalışma bir giriş, iki bölüm ve bir sonuç bölümünden oluşmaktadır. Giriş bölümünde, çalışmanın önemi ve amacı ifade edilmiş, kullanılan yöntemden ve ilgili çalışmalardan bahsedilmiştir. Birinci bölümde, Kanûn-ı Esâsî'nin hem İslam hukuku hem de anayasa hukuku açısından niteliği üzerinde durulmuştur. Ayrıca Kanûn-ı Esâsî ta'dillerine dair tarihî veriler ve Kanûn-ı Esâsî'nin ta'dil usulü aktarılmıştır. İkinci bölümde, bu ta'dillerde değiştirilen, eklenen ve kaldırılan maddeler tek tek ele alınarak, maddenin geçirdiği değişiklik aynen verilmiş ve bu değişikliğin değerlendirilmesi yapılmıştır. Değiştirilen maddelerin özgün hali, değişik hali, kaç değişiklik geçirdiği ve hangi ta'dillerde değiştirildiği ortaya konmuştur. Ardından, Kanûn-ı Esâsî tam metninin özgün hali, üzerine tüm değişiklikler işlenerek eklenmiştir. Sonuç bölümünde ise, Kanûn-ı Esâsî ta'dillerine ve İslam devlet anlayışına dair ulaşılan neticeler sunulmuştur.
This study, which deals with the amendments to Kanun-i Esasi and aims to evaluate the changes made in the articles, consists of an introduction, two chapters and a conclusion. In the introduction, the importance and purpose of the study are expressed, the method used and the related studies are mentioned. In the first chapter, the nature of Kanun-i Esasi in terms of both Islamic law and constitutional law is emphasised. In addition, the historical data on the amendments to Kanun-i Esasi and the amendment procedure of Kanun-i Esasi are conveyed. In the second chapter, the articles that were amended, added and removed in these amendments are analyzed one by one, the change that the article underwent is given exactly and the evaluation of this change is made. The original version of the amended articles, the amended version, how many changes they underwent and in which amendments they were amended are presented. Afterwards, the original version of the full text of Kanun-i Esasi is appended with all the amendments. In the concluding part, the results reached regarding the amendments to Kanun-i Esasi and the understanding of the Islamic state are presented.
