Bir Hanefî fakihi olarak Abdülhay Leknevî ve mezhep içi ihtilafları

Tarihi süreç içerisinde çeşitli mezhepler ortaya çıkmış ve ümmet içerisinde dört mezhep istikrar bulmuştur. Bu mezheplerden biri de Hanefî mezhebidir. Bu mezhep içerisinde çeşitli meselelerde mezhep içi fakihler tarafından mezhep imamına ya da mezhebe muhalif farklı görüşler ortaya konmuştur. Bu muhalefetin mahiyetinin ve gerekçelerinin ortaya konması önem arz etmektedir. Bu bağlamda son dönem fakihlerinden Leknevî, mezhep içi ihtilafa örnek olarak ele alınmıştır. Çalışmamız üç bölümden oluşmaktadır. Birinci bölümde mezhep kavramı, Hanefî mezhebinin teşekkülü, mezhep imamları, ictihad ve çeşitleri, tahrîc, tercih, mezhep içi ihtilafın gerekçeleri ve tarihi seyri, mezhep içi ihtilafa örnek olarak bazı isimler ele alınacaktır. İkinci bölümde, Leknevî’nin hayatı, eserleri, fakihliği, mezhep ve ictihad hakkında görüşleri, bazı fıkhî görüşleri, eserlerinde takip ettiği metod ve kullandığı kaynaklar üzerinde durulacaktır. Üçüncü bölümde ise, tespit edebildiğimiz kadarıyla Leknevî’nin mezhep imamının ya da mezhebin resmi görüşüne muhalif düştüğünü belirlediğimiz bazı furû meselelerle ilgili görüşleri ele alınacaktır.

Various sects have emerged in the historical process and four sects have found stability within the ummah. One of these sects is the Hanafi sect. Within this sect, different opinions have been put forward by the jurists within the sect on various issues against the sect imam or sect. It is important to reveal the nature and justifications of this opposition. In this context, Leknevî, one of the last period jurists, is taken as an example of intra-sectarian conflict. Our work consists of three parts: In the first part, the concept of sect, The formation of the Hanafi school, sect imams, ijtihad and its types, tahrîc, tercih, Reasons and historical course of intrasectarian conflict, Some names will be discussed as an example of intra-sectarian conflict. In the second part, Leknevî's life, works, jurisprudence, His views on madhhab and ijtihad, some legal opinions, In his works, the method he followed and the sources he used will be emphasized. In the third part, as far as we can determine, Leknevî's views on some furû issues that we have determined to be in opposition to the official view of the sect imam or sect will be discussed.
