Özet
İbnü'l-Hümâm (ö. 861/1457), Hicrî IX. asırda yaşamış usûlü'd-dîn, usûlü'l-fıkıh ve usûlü'l-lugayı çok iyi bilen, yed-i tûlâ sahibi çok yönlü, asırlara damgasını vurmuş velûd bir Hanefî fakihi ve müçtehididir. Usül, fürû, nevâzil türü eserlerin ve muhtasar metinlerin yazılarak mezheplerin sistematik hale gelmesi ve görüşlerinin istikrar bulmasından sonra mezhebe bağlılığın öne çıktığı bir dönemde; mezhep içi tercihleri, mezhep imamının görüşünün terk edilmesi ve mezhebe muhalif olan bir görüşün benimsenmesi hususlarında delilin götürdüğü yere gitmekten çekinmemiş ve özgün tercihler ortaya koymuştur. Müçtehit bir âlim olan İbnü'l-Hümâm, mezhebe değil hakka tabi olmayı şiar edinmiş ve mukallit müftüler için ortaya konulan mezhep içi tercih usullerine bağlı kalmamıştır. Bu çalışmada İbnü'l-Hümâm'ın Fethu'l-kadîr li'l-ʿâcizi'l-fakîr ve et-Tahrîr fî ʿilmi'l-usûl adlı eserleri esas alınarak aile hukuku alanındaki tercihleri ve mezhebe muhalif görüşleri incelenmiştir. Aynı şekilde kendisinden sonraki dönemlerde müellifin tercih ve görüşlerinin ne derecede benimsendiği ve sonraki âlimler üzerindeki etkisi de ortaya konulmuştur.
Ibnu'l-Humām (d. 861/1457) that lived in IX. Hijri century, who was a person of seven perfect qualities, highly knowledgeable to principles of religion, jurisprudence, and language, a prolific scholar who left a mark on the centuries, was a jurist and mujtahīd of the Hanafi school. After schools of jurisprudence became systematic through writing the types of books of roots (Uṣūl), branches (furūʿ), Nawāzīl, mukhtaṣār, and the organization of one's opinions systematically, in an era when adherence to a particular school of thought was prominent, he did not hesitate to follow where the evidence led in matters of intra sectarian preference, rejection of the opinion of the imam of the school and embracing an opinion that is opposed to the doctrine of the school and has demonstrated unique preferences. Ibnu'l-Humām who was a mujtahīd scholar has made it a guiding principle to follow the truth not the school and has not adhered to intra-sectarian preference for jurists who adhere strictly to a particular school. In this work, his preferences in family law and his opinions that are contrary to the school of thought have been examined based on his works called Fatḥu'l-qadīr li'l- āʿjizi'l-faqīr and al-Taḥrīr fī iʿlmi'l-uṣūl. Similarly, it also revealed the extent to which his preferences and views were adopted in the following periods and his influence on later scholars.
