dc.description.abstractBu tez, Mâlikî mezhebinde tefrîk uygulamasının sebeplerini ve hükümlerini açıklayarak, Ürdün, Mısır ve Kuveyt Ahvâl-i Şahsiyye kanunlarının tefrîk ile ilgili maddelerinde Mâlikî mezhebinin konuyla ilgili görüşlerinin oranını tespit etmeye çalışmıştır. Bunun yanında bu tezde kanunlarda yer alan görüşlerin hangi mezhebe ait olduğuna açıklık getirilmeye çalışılmıştır. Tez giriş ve iki bölümden oluşmaktadır. Tezin giriş bölümünde konu, amaç, yöntem ve kavramsal çerçeveden bahsedilmiş, birinci bölümde Mâlikî mezhebinde tefrik sebepleri ve hükümlerine yer verilmiştir. Tefrîk sebeplerinde güncellenmesi gereken konuların mezhep kuralları çerçevesinde değerlendirilmesi yapılmıştır. Tezin ikinci bölümünde ise, Ürdün Ahvâl-i Şahsiyye kanununun tefrik ile ilgili maddeleri verilmiş, diğer iki kanuna atıf yapılarak Mâlikî mezhebinin görüşlerinin ne oranda yer aldığı izah edilmiştir. Tefrik ile ilgili maddelerde yer verilen görüşlerin Mâlikî mezhebi ile uyuşmadığı durumda hangi mezhebe ait olduğu tespit edilmeye çalışılmıştır.en_US
dc.description.abstractThis thesis, explaining the reasons and provisions of Tafriq in Malikî school, tries to identify the proportion of Maliki school's related views in the articles of The Jordanian, Egyptian, and Kuwaiti Laws of Personal Status. Besides, this work will be try to clarify which schools the views in aforementioned laws belong to. The work consists of an introduction and two chapters. While the introduction talks about the subject, object, plan and conceptual framework, the first chapter is about the reasons and provisions of Tafrîk in Maliki school. Furthermore, this chapter analyses the subjects of the reasons of Tafrîq needing to be updated in the context of the Maliki school. The second chapter of the thesis mentions related provisions of Jordanian Law of Personal Status and elucidates to what extent Maliki school's views are used with reference to the other two aforementioned laws. And when a provision in not of Maliki school, it is tried to notice which school it belongs to.en_US
