| dc.description.abstract | İslam aile hukukundaki temel konulardan birisi olan muharremât yani kendileri ile evlenilmeleri yasak olan kişilerdir. Muharremât ifadesi kendileri ile evlenme yasağı olan kadınları ifade etmekle beraber kadın açısından bakıldığında aynı konumdaki erkekler de bu kapsamın içerisine girmektedir. Evlenme yasağı sürekli olabileceği gibi geçici de olabilir. Tez çalışmamızda evlenme, evlilik dışı ilişki (zina) ve şehvetle bakma ya da dokunma sonucunda karşı tarafın belirli akrabaları ile evlenme engeli oluşturan “Hürmet-i Musâhere” konusu ele alınmıştır. Çalışmamız bir giriş ve iki bölümden meydana gelmektedir. Giriş bölümünde konunun önemi, amacı, sınırlandırılması ve konuya dair literatür çalışmalarına yer verilmiştir. Birinci bölümde evlilik teriminin kavramsal çerçevesi ortaya konulmuş olup bu bölümde nikâhın anlamı ve tanımı, hükmü, evliliğin kurulmasına dair şartlar, akrabalık kavramı, çeşitleri, akrabalığı oluşturan durumlar ve evlenme engelleri ele alınmıştır. Çalışmamızın ikinci ve son bölümde ise, “Hürmet-i Musâhere” kavramı üzerinde durulmuştur. Bu kapsamda öncelikle evlenme engeli bulunan hısımlardan bahsedilmiş, sonra hürmet-i müsâhereyi meydana getiren durumlar ele alınmış, bu konudaki görüş ve delillere yer verilmiş ve daha sonra bu görüş ve deliler değerlendirilmiştir. Çalışmamız, vardığımız netice ve önerilerimizi içeren bir sonuç bölümüyle tamamlanmıştır. | en_US |
| dc.description.abstract | One of the main issues in Islamic family law is muhạ rramāt, which means women who are forbidden to men to get married. Although the expression of “muhạ rramāt” refers to women, when viewed reverse from women's point of view, men in the same position are also included in this prohibition. The marriage impediment can be permanent or temporary. The main subject of our thesis is "hụ rmat al-musạ̄hạ ra", which creates an impediment of marriage for certain relatives of the other party as a result of marriage bond, adultery, lustful gazing, or touching. Our study consists of an introduction and two parts. In the introduction, the importance, the purpose, and the limitations of the subject, as well as the literature review are presented. The first chapter reveals the conceptual framework of the term marriage. It also discusses the meaning and the definition of marriage, its provisions, the conditions for the establishment of marriage, the concept of kinship, its types, the situations constituting kinship and the impediments of marriage. In the second and last part of our study, the concept of " hụ rmat al-musạ̄hạ ra" is explained. In this context, first, the relatives that constitute marriage impediment through marital relationship were mentioned, then the situations that brought about the reverence are discussed, the opinions and proofs on this subject were given, and then these opinions and proofs are evaluated. In the conclusion section, the results and recommendations of our study are presented. | en_US |
