Özet
Osmanlı son döneminde ekonomik, siyasi, hukuki ve kültürel değişiklikler
yaşanmıştır. Yüzyıllarca statik bir hukuk sistemini devam ettiren Osmanlı
Devleti, Tanzimat'tan sonra dönüşüm geçirmeye başlamıştır. Bu dönüşümle
beraber Osmanlı hukuk sistemi İslam hukukundan Kara Avrupası hukuk
sistemine doğru bir geçiş yaşamıştır. Kanunlaştırmalar yoluyla sağlanan bu
sistemsel geçişin üzerinde hukuk tarihçileri yeterince durmamıştır. Birçok
çalışmada batılı devletlerin mevzuatlarından iktibas edilen kanunlar kronolojik
olarak sayılmış, sistemsel dönüşüme ve bu dönüşümün arkasındaki hukuk
düşüncesine değinilmekle yetinilmiştir. Oysa hukuki gelişmeler fikri
bağlamlarından ayrı değerlendirilemezler. Her kanunun ve hatta her maddenin
dayandığı bir hukuk düşüncesi mevcuttur. Osmanlı son dönemindeki hukuki
değişimde başat rolü de batıcılık fikri oynamıştır.

Tezimizde Osmanlı Devleti’nin hukuk sistemindeki dönüşüm; öncelikle
batıcılık, batılılaşma, hukuk sistemleri, kanunlaştırma ve resepsiyon kavramları
ile Osmanlı’nın batılılaşma sürecini kısaca özetledikten sonra batıcılık fikrini
savunan devlet adamı ve aydınların hukuk düşüncelerini ve bu fikirlerin farklı
hukuk alanlarında nasıl etkili olduklarını araştırmak suretiyle işlenmiştir.
Özellikle II. Meşrutiyet sonrası dönemde öne çıkan batıcı fikir adamlarının
hukuk düşüncelerine ve bunların uygulamadaki etkilerine yoğunlaşılmıştır. Bu
fikir adamlarının hukuka dair yazdıkları makale ve kitaplar dönemin şartları
dikkate alınarak incelenmiştir. Bu incelemeden elde edilen veriler ile devlet
tarafından çıkarılan kanun metinleri karşılaştırmalı bir şekilde ele alınmıştır.
Çalışma sonucunda Tanzimat sonrası bürokrasiye hakim olan batıcılık fikrinin
hukuk sistemindeki dönüşümü sağladığı, batıcı aydınların da anayasal
hareketler aracılığıyla halk arasında meşrutiyet gibi batılı değerleri yaymaya
çalıştıkları ve II. Meşrutiyet sonrası batıcılık akımı içerisinde yer alan Celal
Nuri’nin dönemindeki kanunlaştırmaları da etkileyen bir hukuk anlayışına
sahip olduğu gösterilmiştir.
Economic, political, legal and cultural changes occurred in the late Ottoman period. The Ottoman State, which maintained a static legal system for centuries, began to transform after the Tanzimat era. Along with this transformation, the Ottoman legal system has shifted from Islamic law to European civil law system. Legal historians did not enough research on this systematic transition through legalization. Especially we have focused on the legals views of the intellectuals emerged during second constitutional era, and their effects on the implementation of law. The articles and books written by these intellectuals about the law have been examined considering the conditions of the period. The data obtained from this examination and the texts of the laws issued by the state have been handled comparatively. As a result of the study, it can be concluded that the idea of westernism after the Tanzimat led to the transformation in the legal system and that the intellectuals holding the idea of westernization tried to spread western values such as constitutionality among the people through the constitutional movements.
