| dc.description.abstract | Devlet başkanlarının yetki ve sorumlulukları hükümet sistemlerine göre değişiklik göstermektedir. Devlet başkanlarının sorumlulukları siyasi, hukuki ve cezai sorumluluk başlıkları altında incelenmektedir. Hükümet sistemine göre sorumluluklar azalmakta veya artmaktadır. 16 Nisan 2017 referandumu ile 1982 Anayasasında önemli değişiklikler yapılmıştır. Bu değişiklikler kendine özgü bir hükümet sistemi meydana getirmiştir. Parlamenter sistemin temsili Cumhurbaşkanı yerine aktif bir Cumhurbaşkanı öngörülmüştür. Yeni sistem, Cumhurbaşkanının yetki ve sorumluluklarını değiştirmiştir. Cumhurbaşkanlığı Sistemi adı verilen bu sistemde Cumhurbaşkanının yetkileri artırılmıştır. 2017 Anayasa değişiklikleri ile Cumhurbaşkanının sorumluluğunu düzenleyen hüküm de değiştirilmiştir. 1982 Anayasasının 105. maddesinin başlığı ve içeriği değiştirilmiştir. Cumhurbaşkanının "Sorumluluk ve sorumsuzluk hali" başlığı yerine "Cumhurbaşkanının cezai sorumluluğu" başlığı getirilmiştir. Böylece Cumhurbaşkanlığı sisteminde Cumhurbaşkanının siyasi, hukuki ve cezai sorumluluğu değiştirilmiştir. Değişiklik ile soruşturma usulü ve hükümlerin sonuçları da düzenlenmiştir. 24 Haziran 2018 seçimlerinden sonra Cumhurbaşkanının TBMM'de yemin etmesiyle yeni hükümet sistemi uygulanmaya başlamıştır. | en_US |
| dc.description.abstract | The powers and responsibilities of heads of state vary according to government system. The responsibilities of the heads of state are under the headings of political, civil and criminal responsibility. According to the government system, responsibilities are decreasing or increasing. Significant changes were made in the Constitution of 1982 by a referandum in 2017 on April 16. These changes have created a specific government system. An active president was envisaged instead of the representing president of the parliamentary system. The new system has changed the powers and responsibilities of the president. In this system, which called presidential system, the Powers of the president have been increased. The constitutional amendments to 2017 also changed the provision on the responsibility of the President. The title and content of article 105 of the 1982 Constitution have been changed. The title of "President's criminal responsibility" has been introduced instead of the heading "Responsibility and irresponsibility" of the President. Thus, the political, civil and criminal responsibility of the president in the Presidential System has been changed. The amendment also set out the investigation procedure and article provisions. After the elections of June 24, 2018, the new government system was introduced by the President's oath in the Grand National Assembly of Turkey. | en_US |
