dc.description.abstract"Miras manileri arasında yer alan faktörlerden din farkı" adlI çalışmamızın amacı sahabe döneminden itibaren bu konuyla ilgi farklı ictihadları ortaya koymak ve delil bakımından en güçlü olanı tercih yapmaktır. Çalışmamız giriş ve iki bölümden oluşmaktadır. Giriş Kısmında konuyla ilgili kaynakların tesbiti, mirasin tarihçesi, din kavramı, inanç ve ülke açısından insanların tasnifi konuları incelenmiştir. Birinci Bölümde mirasın kavramsal çerçevesi başlığı altında mirasın rükün, sebep ve manileri incelenmiştir. İkinci bölümde ise din farkının mirasla ilgili hükümleri başlığı altında müslümanlar ile gayri müslimler arasındaki tevarüs, farklı dinlere mensup olan gayri müslimler arasındaki tevarüs ve mürtedle başkaları arasındaki tevarüs konuları incelenmiştir. İslâm hukukçulari gayri müslimin müslümana mirasçı olamaması konusunda icmâ etmişlerdir. Müslümanın gayri müslime mirasçı olup olmaması konusunda ihtilaf etmişlerdir. Cumhur müslümanı gayri müslime mirasçı kılmazken; azınlıkta kalan İslâm hukukçuları müslümanı gayri müslime mirasçı kılmıştır.en_US
dc.description.abstractThe objective of this study, "Religious Difference as one of the Obstacle Factors in inheritance", is to investigate distinct legal opinions since the time of Companions and to prefer the strongest opinion in terms of evidence. This study consists of an introduction and two chapters. In the introduction, topics such as the literature review, the history of inheritance, the concept of religion, classification of humans regarding their faith and country are examined. The conditions of inheritance, its causes and the obstacles from getting inheritance are examined in the first chapter under the title of the conceptual framework of inheritance. In the second chapter, I examined the issues of inheritance between muslims and non-muslims, among different non-muslim groups, and between apostates and others. There is a consensus among the muslim jurisprudents that a non-muslim cannot be the inheritor of a muslim. However, they have disagreed whether a muslim can be the inheritor of a non-muslim or not. The majority of the jurisprudents have stated that a muslim cannot inherite from a non-muslim while a small segment of them have had the opposite opinion.en_US
