dc.description.abstractİslam borçlar hukukundaki temel konulardan olan damân ve taahhüt genel olarak mali ödeme sorumluluğunu ve risk yüklenmeyi ifade etmektedir.Tez çalışmamızda, damân kavramının naslardaki temelleri, fıkıh literatüründeki algılanma ve yorumlanma biçimi, damân teriminin gelişim süreci ve damânın uygulanabileceği konular ve sınırları ele alınmıştır.Çalışmamız bir giriş ve üç bölümden oluşmaktadır. Giriş kısmında konunun fıkıh ilmi içindeki yerine, sınırlandırılmasına, araştırmanın amaç ve yöntemi ile kaynaklarına dair bilgilere yer verilmiştir.Birinci bölümde damân teriminin kavramsal çerçevesi ortaya konulmuştur. Bu bölümde damânın anlamı ve tanımı, damânın mahiyeti, benzer terimlerle ilişkisi, konuyla ilgili naslara yer verilmiştir. Çalışmanın ikinci bölümü damânla ilgili bazı genel kurallar, damân sebepleri, damân ile kefâlet arasındaki farklar konusuna tahsis edilmiştir.Çalışmamızın son bölümü olan üçüncü bölümde ise, damânın uygulanabileceği konular ve sınırları ele alınmıştır. Çalışmamız, vardığımız neticeleri ve önerilerimizi içeren bir sonuç bölümüyle tamamlanmıştır.en_US
dc.description.abstractThe Compensation (Damân) and undertaking, which is one of the main issues in Islamic contract law, refers to financial payment responsibility and assume the risk.In this dissertation, we have discussed the fundamentals of The Compensation, its perception and interpretation in fiqh literature, the process of The Compensation underwent until it was coined as a term, its development process and its impact on contracts. This study consists of an introduction and three chapters. In the introduction, we have given a synopsis of the topic in Islamic law and mentioned the limitations, purpose and method of the study and listed the sources of our research.In the first chapter, the conceptual framework of the term has been discussed. In this chapter, we have dealt with the meaning and definition of The Compensation, relevant quranic and prophetic texts, the nature of The Compensation and its relationship with other similar terms. The second chapter, we have discussed some general rules about the Compensation, The Compensation reasons, the differences between the Compensation and bail; Third chapter we have discussed topics can be applied to the Compensation and limits. The dissertation is completed with a conclusion that summarizes the results we reached and our recommendations.en_US
