| dc.description.abstract | Muhammed Tâhir b. Âşûr'un Talakla İlgili Görüşleri ve Mâlikî Mezhebiyle Mukayesesi Bu çalışma, Mâlikî fakihlerinden olan Muhammed Tâhir b. Âşûr'un (ö. 1973) talakla ilgili görüşleri ve Mâlikî mezhebiyle mukayesesinden oluşmaktadır. Son dönem âlimlerinden olan İbn Âşur Tunuslu ilim ve fikir adamı, fakih, müfessir, muhaddis, tarihçi, filozof, mantıkçı olup Arap dili ve edebiyatında da etkin bir âlimdir. Çalışmada, talak konusunun ilk olarak kavramsal çerçevesi ve çeşitleri ele alınmış olup ilerleyen bölümlerde evliliğin karşılıklı rıza ile sona ermesi, fesih ve tefrik konuları yer almaktadır. Konular öncelikle Mâlikî mezhebindeki farklı görüşlerin ve mezhep içindeki tercih edilen görüşlerin ele alınması ve tercih edilen görüşlerle İbn Âşûr?un görüşlerinin karşılaştırılması şeklinde işlenmektedir. Mâlikî mezhebinin görüşleriyle İbn Âşûr'un fikirlerinin mukayese edildiği bu çalışmanın sonuçları şu şekilde olmuştur: İbn Âşûr genel olarak mezhebine bağlı ancak mezhep taassubundan uzak objektif bir bilim adamıdır. Bununla birlikte çalışmayı oluşturan konuların altısında İbn Âşûr mezhebiyle aynı görüşte iken üç konuda mezhebinin görüşlerinden ayrılmaktadır. | dc.description.abstract | Tâhir b. Âşûr's perception of divorcement and its comparison with the Maliki school jurisprudence This study consists of a Maliki canonist Muhammed Tâhir b. Âşûr's (d. 1973) perceptions related to divorcement and their comparison with the Maliki school jurisprudence. İbn Âşur, a last-era scholar, is an intellectual, canonist, commentator, traditionist, philosopher, logician, and expert in the field of Arabic language and literature. The study first investigates the conceptual framework of the topic and varying types of divorcement. In the next sections, the subjects of mutual consent divorcement, abrogation and dissociation are examined. In discussing the topic, first Maliki School?s varying perceptions of divorcement and the ones that are preferred introduced, then these preferred perspectives and İbn Âşur's thoughts are compared. The findings of this study, where Maliki School perspective and İbn Âşur?s views are compared, reveal the following results: İbn Âşur is usually loyal to the teachings of Maliki School but distant from the school fanaticism as an objective scholar. In addition, while he has shared agreement with Maliki School on the six issues discussed in this study, he has some disagreement with his school on the three issues. However, there is no significant evidence for his agreement or disagreement with the rest of the issues on divorcement. | en_US |
