Özet
Bu çalışmamızda, genel olarak argüman ve argümantasyon kavramlarını
inceleyip hukukta argüman konusuna değinerek söz konusu argümanların
haritalandırılması üzerinde duracağız. Bunu yaparken argüman ve
argümantasyon üzerinde hakimin takdir yetkisi, hukuki yorum, dil ve retorik
gibi unsurların etkisini ele alarak hukukta argüman haritalamayı çeşitli hukuk
metinleri üzerinde inceleyecek, bu anlamda; kanun maddesi, mahkeme
kararları, savcı iddianamesi, avukatın dilekçesi ayrımı yapmaksızın
değerlendirmelerde bulunacağız.
In this study, we will examine the concepts of argument and argumentation in general, and will focus on the mapping of arguments by addressing the subject of argument in law. While doing this, it will examine the effect of factors such as judge's discretion, legal interpretation, language and rhetoric on argument and argumentation, and will examine argument mapping in law on various legal texts. We will make evaluations regardless of the law, court decisions, prosecutor's indictment, lawyer's petition.
