Özet
Tarım bir ülkenin hem ekonomik hem de stratejik bakımdan lokomotif sektörlerinden biridir.
Nüfustaki önlenemez artış ile beraber beslenme ihtiyaçlarının karşılanmasındaki vazgeçilmez araç olan
tarımın önemi de gün geçtikte artmaktadır. Nüfustaki bu artış ve miras kanununun uygulamaları tarım
topraklarının hızla bölünüp parçalanmasına yol açmaktadır. Bu parçalanmayı önlemek ve aynı zamanda
birim topraktan maksimum verim almak amacı ile Kırsal Arazi Düzenlemesi Uygulamalarının başında
gelen Arazi Toplulaştırma Projeleri son yıllarda ülkemizde de yoğun bir şekilde devam etmektedir. Arazi
Toplulaştırma Projeleri kendi içinde birçok işlem barındıran, tamamlanması uzun süren ve maliyet
gerektiren projelerdendir. Bu projelerin uzun zaman almasının nedenlerinden biri de toplulaştırma sahası
içerisinde bulunan taşınmazlardaki mülkiyet problemleridir. Bu çalışma Arazi Toplulaştırma Projeleri
sırasında ve sonrasında ortaya çıkan mülkiyete ilişkin problemleri saptamak ve çözüm önerileri sunmak
amacı ile yürütülmüştür. Çalışmada Konya Ovası Projesi (KOP) Bölgesi kapsamında bulunan illerde
(Aksaray, Karaman, Kırıkkale, Kırşehir, Konya, Nevşehir, Niğde ve Yozgat) yapılan Arazi Toplulaştırma
Projelerinde görev almış DSİ, Tapu Müdürlükleri, Kadastro Müdürlükleri ve özel sektörde görev yapan
nitelikli personeller arasından seçilmiş 140 kişiye anket uygulaması gerçekleştirilmiştir. Anket
uygulanması sonrası elde edilen veriler bilgisayar programı yardımı ile analiz edilmiştir. Anket verilerinin
ölçek güvenirliğinin hesaplanması için ‘Cronbach Alpha’ katsayısı hesaplanmış ve ölçeğin güvenilirliği
test edilmiştir. Faktör analizi öncesi ölçeğin örneklem yeterliğini Kaiser-Meyer-Olki (KMO) ve faktör
analizine uygun olup olmadığını ise Barlett Küresellik testi ile test edilmiştir. Non-parametrik testlerde
ölçek puanlarının sadece ‘Çalışılan Kurum’ bazında anlamlı fark gösterdiğinin belirlenmesi üzerine anlamlı farklılıkların hangi kurumları kapsadığını tespit etmek için Mann-Whitney U testi uygulanmıştır. Anlamlı
fark bulunan kurumların belirlenmesi akabinde her bir ölçek maddesine yönelik ki-kare testi uygulanmıştır.
Katılımcıların görev yaptıkları kurumlar incelendiğinde, katılımcıların %8,6’sının DSİ Bölge
Müdürlüğünde, %24,3’ünün Kadastro Müdürlüğünde, %30’unun Tapu Müdürlüğünde, %29,3’ünün özel
sektörde ve %7,9’unun diğer kurumlarda görev yaptığı görülmektedir. Ankette yer alan Arazi
Toplulaştırma Projelerinde karşılaşılan mülkiyete yönelik problemler projenin tamamlanma süresini
uzatmaktadır ifadesine katılımcıların %1,4’ünün ifadeye kesinlikle katılmıyorum, %1,4’ünün fikrim yok,
%56,4’ünün katılıyorum ve %40,7’sinin kesinlikle katılıyorum cevabını verdiği görülmektedir. Sonuç
olarak Arazi Toplulaştırma Projelerinde ortaya çıkan mülkiyet problemlerinin projelere zaman, maliyet ve
sosyal yönlerde olumsuz etkilerinin olduğu saptanmıştır. Özellikle kadastro parsellerinde karşılaşılan
teknik hataların ve proje alanında bulunan meraların oluşturduğu hukuki durumlar toplulaştırma
projelerinde önemli ölçüde emek ve zaman israfına neden olduğu açıkça görülmüştür. Ayrıca Arazi
Toplulaştırma Projelerinde görev alan paydaş kurumlardaki personellerin önemli bir kısmının Kırsal Arazi
Düzenlemesi Uygulamaları konusunda yeterince hizmet içi eğitim almadıkları belirgin bir şekilde tespit
edilmiştir.
Agriculture is one of the locomotive sectors of a country, both economically and strategically. Along with the inevitable increase in population, the importance of agriculture, which is an indispensable tool in meeting nutritional needs, is increasing day by day. Due to this increase in population and inheritance law, agricultural lands are also rapidly divided and fragmented. In order to prevent this fragmentation and at the same time to get maximum efficiency from the unit soil, Land Consolidation Projects have been continuing intensively in our country in recent years, at the beginning of the Rural Land Arrangement Applications. Land Consolidation Projects are among the projects that involve many processes, take a long time to complete and require cost. One of the reasons why these projects take a long time is the property problems in the immovables within the consolidation area. This study was carried out with the aim of identifying the problems related to property that emerged during and after the Land Consolidation Projects and offering solutions. 140 selected among qualified personnel working in DSİ, Land Registry and Cadastre Directorates and private sector who took part in Land Consolidation Projects in the provinces within the scope of Konya Plain Project (KOP) Region (Aksaray, Karaman, Kırıkkale, Kırşehir, Konya, Nevşehir, Niğde and Yozgat). A questionnaire was applied to the person. The data obtained after the application of the questionnaire were analyzed with the help of a computer program.In order to calculate the scale reliability of the Survey Data, the 'Cronbach Alpha' coefficient was calculated and the reliability of the scale was tested. Before the factor analysis, the sample adequacy of the scale was tested by Kaiser-Meyer Olki (KMO) and whether it was suitable for factor analysis was tested with the Barlett Sphericity test. In the non-parametric tests, it was determined that the scale scores showed a significant difference only on the basis of the 'Institution of Work', and the Mann-Whitney U test was applied to determine between which groups there were significant differences. After determining the institutions with a significant difference, the chi-square test was applied for each scale item. When the institutions where the participants work are examined, it is seen that 8.6% of the participants are in the DSİ Regional Directorate, 24.3% in the Cadastre Directorate, 30% in the Land Registry Directorate, 29.3% in the private sector and 7.9% in other institutions. appears to be working. Ownership problems encountered in Land Consolidation Projects included in the survey extend the completion time of the project. It is seen that 1.4% of the participants strongly disagree with the statement, 1.4% have no idea, 56.4% agree and 40.7% strongly agree. As a result, it has been determined that the property problems that arise in Land Consolidation Projects have negative effects on the projects in terms of time, cost and social aspects. It has been clearly seen that the technical errors encountered in the cadastral parcels and the legal situations created by the pastures in the project area cause a significant waste of labor and time in consolidation projects. In addition, it has been clearly determined that a significant part of the personnel in the stakeholder institutions involved in Land Consolidation Projects do not receive adequate in-service training on Rural Land Arrangement Practices.
