Özet

Endülüs Emevî Devleti’nde (138-422/756-1031) iktidar ve ulemâ ilişkilerini sosyolojik, politik ve hukuki bir perspektifle inceleyen bu çalışma, siyasi otorite ile dinî/entelektüel otorite arasındaki etkileşimi analiz etmektedir. Çalışmanın ana gayesi, bir devletin varlığını sürdürebilmesinin yalnızca askerî güce değil, o tahakkümü meşrulaştıran ve sınırlandıran ulemânın rızasına da bağlı olduğu gerçeğinden hareketle, bu iki güç arasındaki ilişkiyi deşifre etmektir. Tarihsel bir anlatının ötesine geçen bu çalışma, İbn Haldun’un asabiyet teorisini merkeze alarak, organik bir soy birliğine sahip olmayan ulemânın Mâlikî fıkhı etrafında kenetlenip nasıl kitleleri harekete geçirebilen bir dinî-içtimaî asabiyet ürettiğini ortaya koymaktadır. İktidar, toplumsal rızayı sağlamak, meşruiyetini tesis etmek ve devleti yönetmek için ulemânın halk nezdindeki kanaat önderliğine muhtaçtır. Hükümdarlar, ulemâyı müşavir, kadı, hazinedar ve diplomat olarak devletin karar alma mekanizmalarına entegre etmişlerdir. Bu entegrasyonu sağlamak amacıyla ulemâya arazi, ev ve yüksek maaşlar gibi maddî imkânlar sunan bir himaye sistemi kurulmuştur. Ulemâ ise bu destek karşılığında siyasi kararları şer’î bir filtreden geçirmiş, dış ve iç tehditlere karşı devlete hukuki bir meşruiyet zırhı sağlamıştır. Ayrıca bu sistemin içine girmeyi reddeden ulemânın varlığı da tespit edilmiştir. Ulemânın kitleleri yönlendirebilen bu güçlü otoritesi, iktidar tarafından zaman zaman bir beka tehdidi ve siyasi çekince olarak da algılanmıştır. Öte yandan, ulemâ devlet içinde yargı bağımsızlığını tavizsiz bir şekilde savunmuştur. Kâdılar; emirlerin şahitliğini reddetmiş, saray çevresinin mülkiyet gasplarına karşı durmuş, haksız talepler karşısında istifa tehdidini bir silah olarak kullanmış ve hukukun üstünlüğünü en kudretli yöneticilere bile dayatmayı başarmışlardır. İncelediğimiz bu dönemde hanedan içi taht kavgalarında ulemâ kilit bir figür olmuştur. Endülüs Emevî hilafetinin zayıflamaya yüz tuttuğu ve iktidarın fiilen Hâcib Mansûr’un eline geçtiği Âmirîler döneminde ulemânın, siyasi meşruiyetin tesisinde giderek araçsallaştırıldığı ve dönemin güç mücadelelerinde iktidar tarafından yönlendirilmeye çalışıldığı görülmüştür. Bu çalışma, iktidar ile ulemâ arasındaki ilişkinin salt bir itaat veya tek yönlü bir tahakkümden ibaret olmadığını kanıtlamaktadır. Aksine bu ilişki; dönemin şartlarına, yöneticilerin vizyonuna ve ulemânın direniş kapasitesine göre şekillenen, adalet, meşruiyet, himaye ve güç dengesi üzerine kurulu son derece karmaşık, zaman zaman karşılıklı bir çıkar ilişkisine sahne olmuştur.

This study, which examines the relationship between political power and the ulama in the Umayyad State of al-Andalus (138–422/756–1031) from a sociological, political, and legal perspective, analyzes the multilayered interaction between political authority and religious/intellectual authority. The principal aim of the study is to decipher the relationship between these two forces, proceeding from the reality that a state’s capacity to sustain its ontological existence depends not solely upon military power, but also upon the consent of the ulama, who both legitimize and constrain that domination. Moving beyond a merely historical narrative, this study—placing Ibn Khaldun’s theory of asabiyya at its center—demonstrates how the ulama, who possessed no organic bond of lineage, coalesced around Maliki jurisprudence and thereby produced a religious-social asabiyya capable of mobilizing the masses. Political power was dependent upon the ulama’s opinion leadership in the eyes of the populace in order to secure social consent, establish its legitimacy, and govern the state. Rulers integrated the ulama into the state’s decision-making mechanisms as advisors (mushāwir), qadis, treasurers, and diplomats. In order to secure this integration, a system of patronage was established that offered the ulama material benefits such as land, houses, and high salaries. In return for this support, the ulama passed political decisions through a Sharia-based filter and furnished the state with a protective armor of legal legitimacy against both external and internal threats. Furthermore, the existence of ulama who refused to enter into this system has also been identified. This powerful authority of the ulama, capable of directing the masses, was at times perceived by those in power as an existential threat and a source of political apprehension. On the other hand, the ulama uncompromisingly defended judicial independence within the state. Qadis rejected the testimony of emirs, stood against the property seizures of the court circle, wielded the threat of resignation as a weapon in the face of unjust demands, and succeeded in imposing the rule of law upon even the most powerful rulers. In the period under examination, the ulama became a pivotal figure in the intradynastic struggles over the throne. During the Amirid period—when the Andalusian Umayyad caliphate had begun to decline and power had effectively passed into the hands of Hajib al-Mansur—it is observed that the ulama were increasingly instrumentalized in the establishment of political legitimacy and that those in power sought to direct them in the power struggles of the era. This study proves that the relationship between political power and the ulama did not consist merely of obedience or of a unilateral domination. On the contrary, this relationship became the stage for an exceedingly complex, and at times reciprocal, relationship of mutual interest—one founded upon justice, legitimacy, patronage, and the balance of power, and shaped according to the conditions of the era, the vision of the rulers, and the ulama’s capacity for resistance.
