Özet
İslâm, aileyi toplumun temeli olarak kabul eder, nikâh ile de bu kurumu ve nesli
koruma altına alır. İslâm, ailenin huzurlu olması için ailenin fertlerine bir takım maddî ve
manevî sorumluluklar yükler ve haklar tanır. Bu sorumluluk ve haklardan biri de nikâh
akdi sonucu ortaya çıkan nafakadır. İslâm hukukuna göre, nikâh akdi ile birlikte koca
nafakadan sorumlu, eşi de nafakayı hak eden taraf olmaktadır.
İslâm, aile birliğini ve devamını istemekle birlikte boşanmayı da meşru görmektedir.
Nikâh akdi taraflara sorumluluklar ve haklar yüklediği ve sağladığı gibi aynı şekilde
boşanmada da kocanın nafaka sorumluğu, eşinin de nafaka hakkı vardır. Ancak boşanma
nafakasının İslâm hukukunda bir süresi vardır.
Medeni Kanuna göre eşlerden her ikisi de nafaka vermede ve almada hak ve
sorumluluk sahibidir. Boşanma halinde de boşanmadan dolayı yoksulluğa düşecek
tarafın diğerinden nafaka alma hakkı vardır.
Medeni Kanun, boşanma nafakasını İslâm hukukunun aksine bir süre ile
sınırlandırmamıştır. Bundan dolayı boşanma neticesinde yoksul düşen eş, hukuki bir bağı
kalmamasına rağmen ayrıldığı eşinden çok uzun bir süre nafaka alabilmektedir. Bu
durum, İslâm hukuku ile çelişmekte ve kul hakkına sebebiyet vermektedir.
Bu makalede, boşanma nafakası her iki hukuk açısından ele alınacak ve
değerlendirilecektir.
The religion of Islam considers family as the foundation of the society and safeguards this institution and offspring with marriage. Islam levies some sort of financial and moral liabilities upon the members for a peaceful family and grants them several rights. One of these is the issue of alimony resulted from the marriage contract. With this, the wife will have claim for maintenance against her husband responsible for alimony payments, according to the Islamic Law. In addition, Islam advocates family unity and continuity and notwithstanding takes divorce as licit. Like the marriage contract warranting rights and obligations for both spouses, its annulment also makes the husband liable for maintenance at the time of his ex-wife’s claim. Nevertheless, the payments may be made for a limited period of time in the Islamic Jurisprudence. In the Civil Code, both partners have rights and duties to either receive or pay. The side who will be more driven to poverty following the decree of nullity may claim for alimony. The Code of Civil law does not restrict application for separate maintenance with a certain time, unlike the Islamic Law. Therefore, the impoverished spouse may continue to receive alimony payments for a long time after being divorced even though no relation between both sides remained. This situation leads to rightful due issue, which contradicts the Islamic Law. In this article, we will examine and evaluate the issue of separate maintenance with respect to both laws.
