dc.description.abstractİnsan emeğine birçok alanda ihtiyaç duyulması sebebiyle taraflar arasındaki hukuki ilişkinin düzenlenebilmesi için hizmet sözleşmesi kanun hükümleri ile düzenlenmiştir. Hizmet sözleşmesi, 6098 sayılı Türk Borçlar Kanunu'nun 393-447. maddeleri arasında yer almaktadır. Türk Borçlar Kanunu madde 393'e göre hizmet sözleşmesi, işçinin işverene bağımlı şekilde belirli veya belirsiz bir süreyle iş görmeyi, bunun karşılığında işverenin de zamana veya yapılan işe göre ücret ödemeyi üstlendiği sözleşmedir. Türk Borçlar Kanunu'nda hizmet sözleşmesinin hangi hallerde geçersiz olacağına ilişkin özel bir hüküm bulunmamaktadır. Bu sebeple geçersizlik hallerinde Türk Borçlar Kanunu'nun genel hükümlerine bakmak gerekmektedir. Bu çalışmada geçersizlik halleri geniş anlamda ele alınarak öncelikle genel olarak bilgi verilmiş, ardından hizmet sözleşmesi özelinde geçersizlik halleri incelenmiştir. Hizmet sözleşmesinin geçersizliğinin sonradan anlaşıldığı durumlarda, aradaki hizmet ilişkisi ortadan kalkıncaya dek geçerli bir hizmet sözleşmesinin bütün hüküm ve sonuçları meydana gelmektedir. Bu hüküm diğer sözleşmelerin geçersizlik sonuçlarından ayrılan istisnai bir özellik taşımaktadır. Bu çalışmanın konusu hizmet sözleşmelerinin hangi durumlarda geçersiz hale geleceğinin, geçersizliğin doğuracağı hüküm ve sonuçların incelenmesidir.
dc.description.abstractDue to the necessity of human labor in various fields, the service contract is regulated by the provisions of the law in order to regulate the legal relationship between the parties. The service contract is regulated under Articles 393-447 of the Turkish Code of Obligations. According to Article 393 of the Turkish Code of Obligations, the service contract is a contract in which the employee undertakes to perform work for a definite or indefinite period of time dependent on the employer, and in return, the employer undertakes to pay wages according to the time or work performed. The Turkish Code of Obligations does not contain an exceptional provision on the conditions under which service contract will be invalid. For this reason, it is necessary to look at the general provisions of the Turkish Code of Obligations in cases of invalidity. In this study, invalidity cases are examined in a general sense and firstly, general information is given, and then invalidity cases are examined specifically for the service contract. In cases where the invalidity of the service contract is subsequently understood, it must have all the provisions and consequences of a valid service contract until the service relationship is terminated. This provision has an exceptional feature that differs from the invalidity consequences of other contracts. The subject of this study is to examine the conditions under which service contracts become invalid and the provisions and consequences of invalidity.
