dc.description.abstractBüyük muhaddis, fakîh İmam Buhârî (ö 256/869) ve en önemli eseri olan el-Câmius-Sahîh ile ilgili pek çok çalışma yapılmıştir. Ancak onun fıkhî yönünü ele alırken karşılaşılan problemlerden birisi onun ifadeleri arasında yer alan Kâle badun-nâs kavramının anlamı ve muhtevası ile ilgili tartışmalardır. Yaptığımız araştırma neticesinde bu ifadenin, el-Câmius-Sahîhte toplam yirmi beş (25) yerde geçtiğini tespit etmiş bulunmaktayız. Bunlar konu dağılımına göre şu şekildedir: 1 defa Zekât, 2 Hibe, 1 Şehâdet, 1 Vesâyet, 1 Talak, 1 Eyman ven-Nezair, 2 İkrâh, 14 Hiyel, 2 Ahkâmda zikredilmiştir.Buhârî bu ifadesi ile muhataplarına yönelik küçük düşürücü bir tutum sergilememiş, dönemin üslubu gereği bu ifadeyi tercih etmiştir.Eleştiri konusu olan meselelerin hedefinde, genelde Ebû Hanîfe ve onun mezhebini takibeden Hanefî âlimlerinin tercih edilen görüşleri olduğu göze çarpmaktadır.Münakâşa konusu olan meselelerin genelinde, Buhârî ile rey ehli arasındaki ihtilaf, nassları anlama ve tevil farklılığından doğmaktadır. Ayrıca bu çalışmada bahsi geçen meselelere yönelik itirazların sebeplerine ve Buhârînin, eserinde, neden bu tür tartışmalara yer verdiğine ve buna bağlı olarak, daha birçok konuyla ilgili bilgi verilmiştir.en_US
dc.description.abstractThere are a lot of studied about big muhaddeis and Faqih Imam Buhari (256) and his important book el Cami`us Sahih. But when deal his Fiqhi way one of the encountered problem is the meaning and content of `Kale ba`du`n- nas` at the end of our research we identified that it used in el Cami`us- Sahih about 25 place and it is distribution is according to their topic is like this: 1 time in alms, 1 time in witness, 1 time in tutelage, 1 time in divorce, 1 time in Eyman ve`n ?Nezair. 2 times in ikrah, 14 times in hiyel and 2 times I Ahkam. Buhari didn?t use this expression to affront his interlocutors; but choiced it according and needing of that term. As we looked the goal of censures is Ebu Hanife and the scholars who followed his sect`s ideas. The disputation between Buhari and rey ehli is sourcing from difference meaning and understanding of nasses. In this research there are information about the reason of expostulation about that issues, being this kind of discussions and a lot of other issues.en_US
