صحيفة المدينة" التي كانت أولى ّ ّ ُ " الإنسان, وتجسد ذلك الاهتمام واضحا في المواثيق النبوية, وأبرز تلك المواثيق بما يعرف بـ
ت عليها دولة الإسلام بالمدينة, "خطبة الوداع" المشهورة, وقد َ ْ أكدت ّ وكان آخر تلك المواثيق الاتفاقيات الداخلية التي انبن
الوثيقتان على وجوب رعاية حقوق الإنسان الضرورية
وقد ُ اخترت في هذه المقالة أن نقرأ قراءة استنباطية في الوثيقتين; لنربط أولى الوثائق بآخرها, حيث َّ ُ عرفت ّ بكل من
"الوثيقة" و"الخطبة" َ ْ ُ وبسطت مضمونهما, ْ ُ وأبرزت خصائص حقوق الإنسان بين الفكر الإسلامي والفكرالغربي, وضمانات
تلك الحقوق من خلال "الصحيفة" والخطبة", والسمات التي ميزت تلك الحقوق
ثم أسقطت تلك النصوص التي احتوتها "الصحيفة" و"الخطبة" على مواقع الحقوق الضرورية للإنسان, ُ وأيدت تلك
ّ ّ ّ النصوص بأدلة من القرآن الكريم والسنة النبوية. وإنما اهتمت الوثيقتان بالحقوق الضرورية للإنسان للحاجة الماسة لرعاية
تلك الحقوق, أماروافد الحقوق فمبثوثة في بقية نصوصالقرآن الكريم والسنةالنبوية الشريفة
Islam has put a great importance to human rights because Islam came down on the human, and came for the human. This was clearly reflected in the practice of the Prophet including come covenants. The most prominent of these covenants is the "city contitution" of Madina which was the first internal agreement underlying the state of Islam in the city. Whereas the last of these covenants is the famous "farewell sermon". Both of these two historical events and documents have proven the necessary care for human rights in Islam. I have chosen in this article that we read both of the documents in a way that links the first one with the last one. I introduced both documents, evaluated their contents and analyzed the concept of human rights in Islamic thought and Western thought and highlighted the guarantees provided by these two documents. Then I have chosen the human rights issues mentioned in these two documents and supported them by additional evidences provided by the texts of the Qur'an and Sunnah. I rather focused on the very basic and urgent human rights as other secondary rights can be found everywhere in the Koran and the Sunnah.
