Özet
Hukukun adalet amacına ulaşması, yargının tarafsızlığı ile sağlanabilir. Yargının tarafsızlığı, yargının bağımsızlığıyla birlikte değerlendirilmelidir. Bununla birlikte, tarafsızlığın bağımsızlıktan öte bir anlamının olduğu söylenebilir. Nihayet, yargının bağımsızlığının tarafsızlığı sağlamak amacına matuf olduğu belirtilebilir. Bu bağlamda, yargının tarafsızlığının Anayasal bir ilkeye dönüşmesi önemlidir. Yargının tarafsızlığı, esas olarak, hâkimlerin tarafsızlığıdır. Zira yargı erki hâkimler eliyle kullanılmaktadır. Bu bakımdan, ilk derece mahkemesinden itibaren hâkimlerin yaklaşımlarının bireye doğrudan bir yansıması olacaktır. Hâkimlerin hukuku uygularken taraflara eşit konumda bulunmaları ve her iki tarafın iddia ve savunmasına önyargısız yaklaşmaları gerekir. Yargının tarafsızlığı, hukukun ahlakiliğinin yani adaletin ve bu bağlamda hukuk güvenliğinin de temel şartıdır.
Justice that is the goal of the law can be achieved by the impartiality of judiciary. The impartiality of the judiciary should be evaluated together with the independence of the judiciary. However, it can be said that impartiality has broader context than independence. Eventually, it can be stated that the independence of the judiciary is aimed at providing impartiality. In this context, it is important that the impartiality of the judiciary becomes a constitutional principle. The impartiality of the judiciary is mainly the impartiality or neutrality of the judges. Because judicial power is used by judges. In this respect, from the lower court, the judges’ approach will be a direct reflection of the individual. Judges should be in equal position when applying for the law and should be free of prejudice to both parties’ claims and defenses. The impartiality of the judiciary is the basic condition of the morality of the law, that is, the justice and the legal security in this context.
