Özet
Türkiye Varlık Fonu (TVF) 2016 yılının Ağustos ayında kurulduğundan beri çok fazla faaliyette bulunmasa da, hukuki olarak tartışılmaya devam etmektedir. Bu hususta Anayasa Mahkemesi’nin verdiği karar hem yeterince gündeme gelmemiş hem de incelenmemiştir. Anayasa Mahkemesi’nin söz konusu kararında da görüleceği üzere TVF ile ilgili tartışmalar; yasama yetkisinin devredilmezliği ilkesi, Sayıştay denetimi ve bütçe hakkı hususları üzerinde toplanmıştır. Bu çalışmada, Anayasa Mahkemesi’nin konu ile ilgili görüşü dikkate alınarak bu üç konu üzerinden TVF’nin hukuka uygunluğu tartışılacaktır. Güncel bir konu olması hasebiyle Anayasa Mahkemesi’nin TVF ile ilgili verdiği karar bu çalışmada incelenmiş olup, yapılacak yeni çalışmalarla birlikte TVF üzerindeki tartışmaların aydınlatılmasına katkı sağlaması amaçlanmıştır.
Although Turkish Wealth Fund (TWF) has not been doing much since the establishment of the year of August 2016 it continues to be discussed legally. The decision of the Constitutional Court in this respect has not either come to the agenda sufficiently or examined. As seen in the Constitutional Court's decision TWF discussions consist of the principle of non-transferability of legislative authority, the audit of the Courtof Accounts and the budget right. In this study, considering the opinion of the Constitutional Court on the subject, the legality of TWF will be discussed over these three subjects. Due to the fact that it is a current issue, the Constitutional Court's decision on TWF has been examined in this study, with new work to be done, İt is intended to contribute to the clarification of the discussions on TWF.
